HomeMy WebLinkAbout(0052) M&C 19-0291City of Fort Worth, Texas Mayor and Council Communication DATE: 11/05/19 M&C FILE NUMBER: M&C 19-0291 LOG NAME: 80 LANCASTER CORRIDOR / PARKWAY IMPROVEMENTS SUBJECT Authorize the Execution of an Interlocal Agreement with the North Central Texas Council of Governments to Accept Regional Transportation Council Environmental Stewardship Program Funds in the Amount of $200,000.00 and Authorize the Transfer of Funds in the Amount of $600,000.00 from Tax Increment Reinvestment Zone Number 8 - Lancaster to the TIRZ - General Capital Fund for the Lancaster Corridor/Parkway Improvements Project and Adopt Appropriation Ordinances (COUNCIL DISTRICT 9) RECOMMENDATION: It is recommended that the City Council: 1) Authorize the City Manager to enter into an Interlocal Agreement (ILA) with the North Central Texas Council of Governments (NCTCOG) for the Lancaster Corridor/Parkway Improvements Project; 2) Authorize the execution of a Development Agreement with Tax Increment Reinvestment Zone Number 8 (Lancaster Corridor TIF) for landscaping and other streetscape improvements to Lancaster Avenue between Henderson Street and Interstate Highway 35W; 3) Authorize the acceptance of Regional Transportation Council (RTC) Environmental Stewardship Program funds in the amount of $200,000.00 from NCTCOG for the Lancaster Corridor/Parkway Improvements Project; 4) Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Project State Fund in the amount of $200,000.00 for the Lancaster Corridor/Parkway Improvements project; 5) Adopt the attached appropriation ordinance increasing appropriations in the Tax Increment Reinvestment Zone Number 8 - Lancaster Fund (TIRZ #8 - Lancaster Fund) in the amount of $600,000.00, from available fund balance, for the purpose of transferring funds to the TIRZ - General Capital Fund, Lancaster Corridor/Parkway Improvements Project; and 6) Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the TIRZ - General Capital Fund in the amount of $600,000.00 for the Lancaster Corridor/Parkway Improvements Project. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize the execution of an ILA with NCTCOG to accept Environmental Stewardship Program funds in the amount of $200,000.00 and authorize the execution of a Development Agreement with the Lancaster Corridor TIF to accept funds in the amount $600,000.00 for landscaping and other streetscape improvements to Lancaster Avenue between Henderson Street and Interstate Highway I-35W. Environmental Stewardship Program The Environmental Stewardship Program is a NCTCOG direct initiative utilizing RTC local funds. In the case of the Lancaster Corridor, the intent of the program is to support the use of corridor landscaping to mitigate the heat-island effect of urban development. The program funds must be used for the design, installation, and/or maintenance of corridor landscape planting and irrigation. The funds will be distributed on a reimbursement basis as periodic milestones of implementation are completed. Lancaster Corridor/Parkway Existing corridor/parkway landscape improvements along Lancaster Avenue are generally located at the outer edges of the roadway utilizing tree wells and small planting areas built into the sidewalks. These existing corridor/parkway landscape improvements were completed as part of the Texas Department of Transportation (TxDOT) Lancaster Avenue street project which was designed in 2004 and constructed in 2005. No median landscaping was included in that project. While this project will primarily focus on median landscaping, the need for replacement of existing landscaping in decline and/or the need for addressing gaps in landscaping along the outer edges of the roadway will be identified during the course of this project. In FY2019, there was a budgeted use of $600,000.00 from TIRZ #8 - Lancaster Fund to the TIRZ General Capital Fund, for the Lancaster Corridor/Parkway Improvements project. The budget appropriations were created, but actuals were never transferred in FY2019. Since the transfer was not completed in the prior year, it requires an appropriation to complete the transfer in the current year, using fund balance. This project is located in COUNCIL DISTRICT 9. This M&C does request approval of a contract with a governmental entity, state agency, or public institution of higher education: Tax Increment Reinvestment Zone Number 8 (Lancaster Corridor TIF) and North Central Texas Council of Governments (NCTCOG). A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinances, funds will be available in the current operating and capital budgets, as appropriated, in the TIRZ #8 - Lancaster Fund, the TIRZ General Capital Fund, and the Grants Capital Project State Fund. The Park & Recreation Department will be responsible for the collection and deposit of funds due to the City. Prior to expenditure being incurred, the Park & Recreation Department has the responsibility to validate the availability of funds. This is a reimbursement grant.
