HomeMy WebLinkAboutOrdinance 16786-01-2006ORDINANCE NO. 1678b-1-2046 AN ORDINANCE VACATING A 7G.5' X IUD' PORTION OF WEST MAGNOLIA AVENUE CONTAINING APPROXIMATELY 7,879 S12UARE FEET, OR 0.181 ACRES, OF LAND AS LOCATED IN THE ALL SAINTS EPISCOPAL AUDITION, AS RECORDED IN CABINE'T' A, SLIDE 1411 PLAT RECORDS, TARRANT COUNTY, TEXAS; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DA'T'E. TIE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a 7b.5' x 120' portion of West Magnolia Avenue containing approximately 7,879 square feet, or 0.181 acres, of land as located in the All Saints Episcopal Addition, as recorded in Cabinet A, Slide 1411 Plat Records, Tarrant County, Texas, and as nnore specifically desenbed in Exhibit "1 ", "2" and " 3" attached hereto and incorporated herein by reference, be and the sarrae is vacated and extinguished. SECTION ~, That existing utility easements shall be retaiuned by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 3. That the fee to the land in the above-described street rights-aFway is released and shall revert to the adjacent owner as provided by law. SECTION 4. That all ordinances ar parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. DISCUSSION: Brittain and Crawford, an the behalf of Ali Saints Hospital of Fort Worth, has requested vacation of the above referenced right-af-way, to be incorporated into the adjacent property. The Engineering Depar#ment, Real Property Services Division, states that the administrative fee of $100 has been received. Reviewing City departments and public utility companies have raised na objections to this request. The City Plan Commission recommended approval of this request at its meeting on December 23, 2005. Any existing utilities will be relocated at the applicant's expense. An acceptable replat has been received. The property is located in COUNCIL DISTRICT 9.
