Consider Request for Waiver of Mandatory Twelve Month Delay in Refiling a Zoning Request at 6828 North Freeway (ZC-19-145) (COUNCIL
DISTRICT 4)
RECOMMENDATION:
It is recommended that the City Council consider a request from AJNM Investment, LLC, for a waiver of the mandatory twelve month delay period
as required by the Zoning Ordinance for a rezoning request for 6828 North Freeway (ZC-19-145) and if the waiver is granted, authorize the
acceptance of a new zoning application.
DISCUSSION:
On October 15, 2019 the City Council held a public hearing for ZC-19-145 in which AJNM Investment, LLC (AJNM) made a request to rezone
6828 North Freeway to a planned development district to allow a four story hotel on the property that is within 1,000 feet of an A-5 residential
district. On September 11, 2019, the Zoning Commission held a public hearing at which it was reported by staff that the requested change was
both compatible with the existing land uses and consistent with the Comprehensive Plan. The Zoning Commission made a recommendation of
approval to the City Council for the rezoning request. The City Council denied the rezoning request after receiving neighborhood opposition to a
five story hotel. AJNM will not be able to apply for a similar rezoning application for a hotel for twelve months without the approval of a waiver by the
City Council.
Section 3.506 of the Zoning Ordinance allows an applicant to request from the City Council a waiver of the mandatory delay period and to
authorize the acceptance of a new application based on a description of substantially changed conditions in the community since prior
consideration of the case. AJNM has submitted such a request based on additional contact made with the community, Carrington Court Home
Owners Association Board to further explain and describe his rezoning requst. His request for the waiver is attached, as is the letter from
Carrington Court Home Owners Association Board.
After the City Council meeting it became known to AJNM that there had been a misunderstanding by the neighborhood with regard to height of the
hotel that was being proposed by the community. The neighborhood community believed the hotel to be five stories in height rather than the four
stories originally presented to the Zoning Commission and to the City Council. AJNM presented the proposed four story hotel project to the
Carrington Court Home Owners Association Board (Board) at a meeting on October 24, 2019. AJNM also agrees other issues of concern to the
Board regarding noise and odors after which the Board provided the attached letter.
The property is located in COUNCIL DISTRICT 4.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.

The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
