A RESOLUTION AUTHORIZING THE EXECUTION OF A LOCAL PROJECT ADVANCE
FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN
THE AMOUNT OF $5,000,000.00 FOR DESIGN AND CONSTRUCTION OF ON- STREET
PARKING, LANDSCAPING, BICYCLE AND PEDESTRIAN IMPROVEMENTS ON EAST
ROSEDALE STREET FROM IH -35W TO U.S.287
WHEREAS, the State has received money from the North Texas Tollway Authority for the right to
develop, finance, design, construct, operate, and maintain the SH 161 toll project from IH 20 to SH 183 Dallas
County ( "SH 161 payments "); and
WHEREAS, pursuant to Transportation Code, 228.006 the State shall authorize the use of surplus
revenue of a toll project for a transportation project, highway project, or air quality project within the district of
the Texas Department of Transportation in which any part of the toll project is located; pursuant to Transportation
Code, §228.012 the State has created a separate subaccount in the state highway fund to hold such money (SH
161 Subaccount), and the State shall hold such money in trust for the benefit of the region in which a project is
located, and may assign the responsibility for allocating money in the subaccount to a metropolitan planning
organization (MPO); and
WHEREAS, in Minute Order 110727, dated October 26, 2006, the Texas Transportation Commission
(the "Commission ") approved a memorandum of understanding (MOU) with the Regional Transportation Council
(RTC), which is the transportation policy body of the North Central Texas Council of Governments (NCTCOG)
and a federally designated MPO, concerning in part the administration, sharing, and use of surplus toll revenue in
the region; under the MOU the RTC shall select projects to be financed using surplus revenue from a toll project,
subject to Commission concurrence; and
WHEREAS, the City of Fort Worth identified the need to retrofit East Rosedale Street from lH -35W to
U.S. 287 by eliminating the two outside lanes in order to provide on- street parking, landscaping, bicycle and
pedestrian improvements under a context sensitive approach to enhance the corridor; and
WHEREAS, the Regional Transportation Council of the North Central Texas Council of Governments
selected the East Rosedale Street Retrofit project from IH -35W to U.S. 287 to be financed to provide on- street
parking, landscaping, bicycle and pedestrian improvements; and
WHEREAS, the City of Fort Worth desires to enter into a Local Project Advance Funding Agreement
with the Texas Department of Transportation to design and construct the East Rosedale Street Retrofit project
from IH -35W to U.S. 287 to provide on- street parking, landscaping, bicycle and pedestrian improvements.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
That the City Manager is authorized to execute a Local Transportation Project Advance Funding Agreement
(LPAFA) with the Texas Department of Transportation in the amount of $5,000,000.00 for the City of Fort Worth
to design and construct the East Rosedale Street Retrofit project from EH -35W to U.S. 287 to provide on-street
parking, landscaping, bicycle and pedestrian improvements.

Adopt Resolution Authorizing the Execution of a Funding Agreement with the Texas Department of
Transportation in the Amount of $5,000,000.00 for Design and Construction of East Rosedale Streetscape
Improvements from Interstate 35VV to U.S. 287 and Adopt Appropriation Ordinance (COUNCIL DISTRICT
RECOMMENDATION:
Itis recommended that the City Council:
1. Adopt the attached resolution authorizing the execution nf a funding Agreement with the Texas
Department of Transportation in the amount of $5,000,000.00 for design and construction of East
Rosedale atreetsoape inlpnJwennenta from Interstate 35VVtD U.G. 287;
2. Authorize acceptance of Regional Toll Revenue Funds in the amount of $4,000,000.00 via the Texas
Department mf Transportation tnbe applied towards the project;
3. Authorize the transfer in the amount cf $1.0O0.00O.00 from the 2O87 Critical Capital Projects Fundto
the Grant Capital Projects Fund to be applied towards the City's match; and
4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations inthe
Grant Capital Projects Fund in the amount of $5,000,000.00.
Execution of this funding Agreement in the amount of $5,000,000.00 allows for State funding participation
in design ond construction. Funding includes $4,000,000.00 in Regional Toll Revenue funds and
$1'000'0OO.ODin City 0[ Fort Worth 2U07 Certificate nf Obligation funds. East Rosedale Street from |H-
35VVto U.S. 287 is currently six lane divided arterial. The project will eUnninate the two outside lanes in
order to provide on-street parking, landscaping, bicycle and pedestrian improvements under acontext
sensitive approach to enhance the corridor, East Rosedale Street from |H-35W to U.S. 287 is a four lane
divided arterial on the City's Master Thoroughfare Plan.
The State will send the City of Fort Worth a check inthe amount of $800.00.00VO later than 30days
after the start of fiscal year 2013 and a second check in the amount of $3,200,000.00 no later than 30
days after the start of fiscal year 2014 for a total amount of $4,000,000.00. The Transportation and Public
Works Department will be responsible for the collection of State funds.
