Adopt the attached ordinance vacating portions of Live Oak Street, East 2nd Street and East 3rd Street for existing railroad right-of-way for the new TEX Rail commuter rail line; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Stateside Right -of -Way, on behalf of the Fort Worth Transportation Authority, has requested the vacation of these portions of Live Oak Street, East 2nd Street and East 3rd Street for existing railroad right-of-way for the new commuter rail line, TEX Rail. The City of Fort Worth has completed a realigment of Live Oak Street to replace the vacated right-of-way in this area and preserve adequate area circulation. The City Plan Commission recommended approval of this request at its meeting on June 28, 2017. The City Plan Commission also approved a waiver of the requirement to replat the vacated right-of-way with the adjoining property. The City of Fort Worth (City) originally obtained the above mentioned rights -of -way through platting process. The City does not own any fee interest in the rights -of -way or own any property adjacent to the rights -of -way and did not expend any City funds to purchase the right-of-way easements. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of the rights -of - way easements for the streets. This project is located in COUNCIL DISTRICT 8. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
