REDUCING THE BOUNDARIES OF
FORT WORTH PUBLIC IMPROVEMENT` DISTRICT NO. 7
(HERITAGE PID)
WHEREAS, on August 22, 2000 the City Council received a petition (the
"Petition") for the establishment of Fort Worth Public Improvement District No. 7 (the
"Heritage PID" or "PID") from various owners of property within the boundaries of the
PID proposed in the Petition; and
WHEREAS, pursuant to Chapter 372 of the Texas Local Government Code (the
"Code"), on September 26, 2000 the City Council adopted Resolution No. 2675 creating
the PID and describing its boundaries; and
WHEREAS, since establishment of the PID, property within and near the PID
boundaries has been replatted, resulting in six (6) lots that now are bisected by the PID
boundaries; and
WHEREAS, special assessments for PID services and improvements can only be
levied against property located within the PID boundaries; and
WHEREAS, all property located within the boundaries of this PID is subject to
the levy of such assessments; and
WHEREAS, because the method of levying special assessments against property
in this PID is based on the overall taxable appraised value of that property, It would be
difficult to calculate a proper assessment against those lots that are located only partially
in the PID; and
WHEREAS, Section 372.012 of the Code permits the City Council to exclude
property described in the Petition from the boundaries of the PID; and
WHEREAS, of those lots that are located only partially within the PID, the
portions of those lots that are located outside the boundaries of the PID were not
included in the Petition requesting establishment of the PID; and
WHEREAS, it would be administratively curnbersome to leave the current
boundaries of the PID intact and then specifically exempt from assessment each year
those portions of the lots bisected by the PID boundaries that are located outside the
PID;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
1. THAT those six (6) lots identified below and shown in the map attached hereto
as Exhibit "A" are hereby removed from the PID in their entirety and shall not
be subject to assessment from and after the effective date of this Resolution

9525 Bewley Ct., Block 1.60, Lot 44, Heritage Addition

9529 Sinclair St., Block 160, Lot 17, Heritage Addition
2. THAT this Resolution shall take effect immediately upon its adoption.

Conduct a Public Hearing and Adopt Resolution Reducing Boundaries of Fort Worth Public Improvement
District No. 7, Heritage P|O(COUNQL DISTRICTS 4ond 7)
|tks recommended that the City Council:
1. Conduct a public hearing to consider the removal of six lots from Public Improvement District No. 7,
Heritage PID; and
2. Adopt the attached Resolution reducing the boundaries of the Heritage P|D by removing the six lots in
question.
The City Council created Public Improvement District (PID) No. 7 (the Heritage PID) on September 26,
2000 pursuant Vo Resolution No. 2675. Since establishment of the Heritage P|D, property within and near
the PID boundaries has been replatted, leaving six lots that are bisected by the PID's boundaries. Those
lots are:
w 0500 Peat Court, Block 160, Lot 74, Heritage Addition;
* 9513 Peat Court, Block 1OO. Lot 7O. Heritage Addition;
p S525 Bewley Court, Block 18O. Lot 44. Heritage Addition;
* 9528 Bewley Court, Block 160`Lot 57. Heritage Addition;
* 9528 Sinclair Street, Block 160. Lot 29, Heritage Addition; and
* 0528 Sinclair Street, Block 1OO' Lot 17. Heritage Addition.
A map showing the lots in question is attached as Exhibit A to the attached Resolution.
PID assessments can only be levied against property that is located within the boundaries of the district.
Because the method of levying special assessments against property in the Heritage PID is based on the
overall taxable appraised value of that propedy, it would be extremely difficult br oa|ou|eh* a proper
assessment against the Six lots that are |oo@bad only partially in the P|D.
As a result, it is recommended that after receiving any comments from the public on this matter, the City
Council close the public hearing and adopt the attached Resolution removing the six lots from the Heritage
PID entirely.
