Authorize Amendment No. 2 to the Design Procurement Agreement (DPA) with the Bass Foundation, LLC, to Provide for Reimbursement of
Additional Professional Engineering and Design Expenses for Phase II of the Project for the Extension of Trail Drive and Improvements to
Adjacent Trinity Park (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council authorize Amendment No. 2 to the Design Procurement Agreement (DPA) with the Bass Foundation,
LLC to provide for reimbursement of additional professional engineering and design expenses for Phase 11 of the Project for the extension of Trail
Drive and improvements to adjacent Trinity Park.
DISCUSSION:
On May 16, 2017 City Council authorized a Design Procurement Agreement (DPA) with the Bass Foundation (the Foundation) for the design
efforts related to the extension of Trail Drive and improvements to adjacent Trinity Park (M&C C-28245). The DPA (CSO No. 49303) was to
reimburse the Foundation an amount not to exceed $1,225,000 for the design expenses incurred by the Foundation related to:
1. Phase I - The extension of Trail Drive and Van Zandt Way (City Project No. 100742)
2. Phase II - The schematic design for expansion of the landscaping surrounding Van Zandt Cottage and adjacent parkland improvements
Amendment No. 1 (CS 49303-A1) provided for the inclusion of certain additional improvements requested by the Foundation to the project
construction contract. It also allowed the City to offset reimbursements to the Foundation by an amount equal to that which the said improvements
caused the City project budget to be exceeded.
This Amendment No. 2 provides for the full reimbursement of design expenses for Phase II so long as the aggregate of expenses for both Phase I
and II does not exceed $1,225,000. Staff has reviewed the Foundation's Phase II design expenses and finds them to be fair and reasonable and
within the maximum reimbursement amount of $1,225,000.
Phase I of the project is substantially complete with the extension of Trail Drive now open to traffic. Phase II is underway and anticipated to be
completed by September 2019.
This project is in Council District 9.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that this action will have no material effect on City funds.
