Report of City Staff: David Creek; b. Citizen Presentations; c. Council Action: Close Public Hearing and Approve the M&C) RECOMMENDATION: It is recommended that the City Council: 1. Conduct a public hearing under the guidelines set forth by the Texas Parks and Wildlife Code, Chapter 26, Protection of Public Parks and Recreational Lands; 2. Find that no feasible or prudent alternative exists for the use of Gateway Park for the installation of a sanitary sewer line with associated infrastructure; 3. Find that the proposed installation of a sanitary sewer line with associated infrastructure includes all reasonable planning to minimize harm to the parkland, including that all infrastructure and equipment will be constructed in Gateway Park as specified on the attached exhibits and as noted in the discussion below; and 4. Close the public hearing and authorize the use of approximately 0.029 acres of dedicated parkland at Gateway Park for the proposed sanitary sewer line with associated infrastructure improvements. • Gateway Park - located at 751 Beach Street, south of First Street, west of Oakland Blvd, north of 1-30, east of Beach Street, in Council District 4 DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize the use of a portion of parkland at Gateway Park for the installation of a sanitary sewer line with associated infrastructure improvements. The City of Fort Worth Water Department (WD) is requesting the use of a portion of the Gateway Park (Park) for the installation of a sanitary sewer line. The project involves the installation of one (1) 36" bypass sewer line and three (3) manholes. The sanitary sewer line will allow for the rerouting of flow between an existing 60" and 84" sewer line that feeds into an existing 96" sanitary sewer line that is in need of repair. The proposed manholes may vary in size based on the location and depth of the lines. The installation of the permanent bypass line will reduce impacts to the Park for future maintenance on the existing lines. The Park will remain open during construction. The proposed sanitary sewer bypass line will be installed at a minimum depth ranging from five (5) feet to ten (10) feet. The proposed project will encompass approximately 1,300 square feet of maintenance area. On July 24, 2019, the Park & Recreation Advisory Board endorsed Staffs recommendation to the City Council to authorize the use of Gateway Park for the installation of sanitary sewer line with associated infrastructure. In accordance with State law, public notice of the hearing was advertised in the Fort Worth Star -Telegram on Septermber 19, 2019, September 26, 2019 and October 3, 2019. An exhibit map was available for public review at the Park & Recreation Department administrative offices located at 4200 South Freeway, Suite 2200, Fort Worth, Texas 76115. A letter announcing the proposed use was sent to the presidents of the White Lake Hills Neighborhood Association on September 16, 2019. Signage was posted at the site noting the proposed use and providing instructions for directing comments to the Park & Recreation Department.
