HomeMy WebLinkAbout(0036) RESOLUTION - Mark IV Const Group.Golden Triangle LibraryA Resolution AUTHORIZING THE CITY MANAGER TO EXECUTE AN INDIVIDUAL JOB ORDER WITH THE MARK IV CONSTRUCTION GROUP, LLC TO COMPLETE CONSTRUCTION OF THE GOLDEN TRIANGLE LIBRARY WHEREAS, on May 16, 2017, the City Council authorized execution of a construction contract with Denco CS Corporation ("Deno") in the amount of $4,770,611.10 for the Far North Library ("Golden Triangle Library") as part of the 2014 Bond Program (M&C C-28246, CSC #49244); WHEREAS, although construction of the Golden Triangle Library is currently 90% complete, City staff is not confident that Denco will be able to complete the remainder in a timely manner; WHEREAS, the City wishes to terminate the construction contract with Denco and hire a Job Order Contractor to complete construction of the Golden Triangle Library using funds available in the existing project budget; WHEREAS, on August 15, 2017, City Council authorized the execution of a Job Order Contract services contract with The Mark IV Construction Group, LLC ("Mark IV") (M&C C-28325); WHEREAS, City staff believes that Mark IV will be able to complete construction of the Golden Triangle Library within an acceptable timeframe; WHEREAS, a waiver of the goal for MBE/SBE subcontracting requirements was requested by the Property Management Department and approved by the Office of Business Diversity, in accordance with the MWBE or DBE Ordinance; and WHEREAS, Texas Government Code Section 2269.403(c) states that the governing body of a government entity must approve each job, task, or purchase order under a Job Order Contract that exceeds $500,000.00; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: The City Manager is hereby authorized to execute an individual Job Order with The Mark IV Construction Group, LLC in an amount not to exceed $700,000.00 to complete construction of the Golden Triangle Library.
