Adopt a Resolution Physically Closing a Portion of East 1 st Street and Peach Street at Railroad Crossings between West Hampton Street and
Live Oak Street (COUNCIL DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council adopt the attached resolution to physically close a portion of East 1st Street and Peach Street at railroad
crossings between West Hampton Street and Live Oak Street.
DISCUSSION:
The Transportation Public Works Department has requested the physical closure of these portions of East 1 st Street and Peach Street to permit
permanent closure of these two railroad crossings. The City Plan Commission recommended approval of this request at its meeting on August
28, 2019.
The City will install gates that meet the requirements of the Transportation and Public Works Department.
The City will retain title to the public right-of-way in the streets, retain any and all easements for existing and prospective utilities, and retain the right
of access at all times for the purpose of maintaining existing and prospective utility facilities and for emergency access.
The City reserves the right, at the sole discretion of the City Council, to reopen by resolution the street right-of-way to public travel at any time by
directing the removal of any barricade or other means of closure, and reconstruction of the roadway.
This project is located in COUNCIL DISTRICT 8.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
