SSSiMM, ALIM AND PUBLIC THOROUGHFARES OF THE CITY
OF FORT WORTH, TEXAS, FOR THE POMPOM OF LAYING,
MAINTAINING, USING AND OPMATING THEREIN PIPS LIl1FS
TO HANDLE GAS TO DOMESTIC, CO AMCIAL AND INDUSTRIAL
CUSTOMLRS LOCATED IN SAID CITY; DIRECTING HOW PERMITS
MAY BE GRANTED FOR LDMS TO HE EXTENDED, RELAYED, RS-
PAIRSD, Low=D AND REIACATED; PROVIDING THAT THE CITY
SHALL BE HELD HARiiLTSS FROM ANY DAMAGES CAUSED BY THE
CONSMOTION AND MOINTEUNCI OF SUCH LINES; AND PRO-
VIDING FOR THE ACCEPTANCE OF SAME.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
SECTION 1.
That the City of Fort Worth, Texas, called *City," hereby grants
its consent to the use of its present and future streets, alleys and public
thoroughfares by Lone Star Gas Company, its successors and assigns, herein
called "Company,N for the purpose of laying,maintaining, using and operat-
ing thereon the pipe lines and appurtenant equipment necessary to deliver
gas to domestic, commercial and industrial customers located within the
City ►s corporate limits, said consent being granted for a term of twenty -
five (25) years from the date this ordinance is adopted and approved.
SECTION 2.
Company shall lay, maintain and operate its lines and equipment so
as to interfere as little as possible with traffic and shall promptly restore
all thoroughfare and other surfaces which it may disturb to their original
condition. Before Company shall be authorized or required to extend, repair
or relay its existing gas mains or street service lines, there shall be filed
with the Director of Public Works a written statement showing the nature and
character of the extensions proposed to be made. Company shall lower, relocate
or relay existing gas mains or street service lines where necessary due to the
lowering of street grades by the City at its own cost and expense.

SECTION 3.
Company's property and operations in the City, shall be subject
to such regulation by the City as may be reasonably necessary for the pro-
tection of the general public.
SECTION 4.
Company shall hold the City harmleas from all expense or liability
for any act or neglect of the Company hereunder.
SECTION 5.
Nothing herein contained shall ever be held or construed to con-
fer upon Company exclusive rights or privileges of any nature rdiatsoever.
SECTION 6.
This ordinance shall be in force and effect from and after its
passage, Provided Company, within sixty (60) days thereafter, files its
written acceptance thereof with the City Secretary.

Gentlemen:
In accordance with the provisions of Section
6 of that certain ordinance finally adopted and ap-
proved by the City Council of the City of Fort Worth,
Texas, on the llth day of June, 1941, numbered 2113,
and captioned:
"AN ORDINANCE GRANTING CONSENT TO THE
LONE STAR GAS COMPANY, ITS SUCCESSORS
AND ASSIGNS, TO USE THE STREETS, ALLEYS
AND PUBLIC THOROUGHFARES OF THE CITY OF
FORT WORTH, TEXAS, FOR THE PURPOSE OF
LAYING, MAINTAINING, USING AND OPERATING
THEREIN PIPE LINES TO HANDLE GAS TO DO-
MESTIC, COMMERCIAL AND INDUSTRIAL CUS-
TOMERS LOCATED IN SAID CITY; DIRECTING
HOW PERMITS MAY BE GRANTED FOR LINES TO
BE EXTENDED, RELAID, REPAIRED, LOWERED j
AND RELOCATED; PROVIDING THAT THE CITY
SHALL BE HELD HARMLESS FROM ANY DAMAGES
CAUSED BY THE CONSTRUCTION AND MAINTEN-
ANCE OF SUCH LINES; AND PROVIDING FOR
THE ACCEPTANCE OF SAME11
Lone Star Gas Company files this, its written accept-
ance of said ordinance, and a certified copy of a reso-
lution duly adopted by its Board of Directors authorizin
the execution and filing of such acceptance. g

I, D. L. COBB, Secretary of Lone Star Gas
Company, a Texas corporation, do hereby certify that
at a meeting of the Board of Directors of said com-
pany duly convened and held at the office of said
company in the City of Dallas, Texas, on June 13,
1941, at which meeting a quorum of said Board was
present, the following resolutions were duly adopted:
"BE IT RESOLVED that the contract en-
tered into by and between the City of
Fort Worth, acting by and through its
Mayor, I. N. McCrary, and duly attested
by its City Secretary, E. S. Birdsong,
and Lone Star Gas Company, acting by
and through F. L. Carmichall, Manager
of the Fort Worth Division of Lone Star
Gas Company, and duly attested by its
Assistant Secretary, Chas. G. Hess, Jr.,
on the 11th day of June, 1941, whereby
the said parties agreed upon and to the
payment of an annual rental for a period
of ten years from the date of said con-
tract for the use and occupancy by Lone
Star Gas Company, its successors and as-
signs, of the streets, alleys and public I
thoroughfares of said city, be and the
same is hereby ratified, confirmed and
adopted.
"BE IT FURTHER RESOLVED that F. L. Car -
michall, Manager of the Fort Worth Di-
vision of Lone Star Gas Company, be and
he is hereby authorized, empowered and
directed to execute in the name and on
behalf of this company, and to file with
the City Secretary of the City of Fort
Worth, Texas, written acceptance of
that certain ordinance enacted by the
City of Fort Worth on the 11th day of
June, 1941, being Ordinance No. 2113
of said city, whereby said city evi-
denced its official consent for Lone
Star Gas Company, its successors and
assigns, to occupy and use, for a pe-
riod of twenty -five years from date of
adoption and approval of said ordinance,
the streets, alleys and public thorough-
fares of said city for the purpose of
laying and operating therein its pipe
lines and appurtenances thereto neces-
sary to deliver gas to domestic, com-
mercial and industrial consumers with-
in said city's corporate limits.?,
TO CERTIFY WHICH, witness my hand as Secretary
of said Lone Star Gas Company and the seal of said com-
pany, this the 13th day of June, 1941.
