HomeMy WebLinkAbout(0149) M&C 20-0316City of Fort Worth, Mayor and DATE: 05/05/20 Texas Council Communication LOG NAME: 60REMERSS52264-CONATSER SUBJECT M&C FILE NUMBER: M&C 20-0316 Ratify an Emergency Contract with Conatser Construction TX, LP, in the Final Amount of $367,118.65 for Emergency Sanitary Sewer Repair Work Performed on Trinity Park and Trinity River Tributary Creek (COUNCIL DISTRICT 4) RECOMMENDATION: It is recommended that the City Council ratify an Emergency Agreement with Conatser Construction TX, LP, City Secretary No. 52264, in the final amount of $367,118.65 for emergency sanitary sewer repair work performed on Trinity Park and Trinity River Tributary Creek (City Project No. 102295). DISCUSSION: The emergency work performed provided for the replacement of a 40-foot collapsed segment of Main 439 in Trinity Park and also the reroute of a segment of cracked Main 208 from its inaccessible location at the bottom of a tributary creek of the Trinity River to a location further away from the creek edge near 9065 John T. White Road. It was beyond the City's ability to perform repairs of this complexity. The Water Department engaged Conatser Construction TX, LP for the emergency sanitary sewer repair work performed on the Trinity Park and Trinity River Tributary Creek. The attached City Manager Memo dated April 25, 2019 and June 20, 2019 supplemental memorandum authorized City Secretary Contract No. 52264, and Change Order 1 thereto, for the emergency work up to $1,100,000.00. The total construction cost was $367,118.65, which is fair and reasonable for the work performed. Upon ratification of this contract, this project is completed and is ready to close. Sanitary Sewer Overflows are a threat to the health and safety of the City of Fort Worth. Chapter 2, Article I, Section 2-9 of the City's Code of Ordinances and Section 252.022 of the Local Government Code exempts from normal bidding requirements expenditures that are necessary to preserve or protect public health or safety of the municipality's residents and procurements that are necessary because of unforeseen damage to public machinery, equipment, or property.
