HomeMy WebLinkAboutOrdinance 20434-09-2012Ordinance No. 20434 -09 -2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANT CAPITAL PROJECTS FUND IN THE AMOUNT OF $5,000,000.00, FROM AVAILABLE FUNDS, TO DESIGN AND CONSTRUCT ON- STREET PARKING, LANDSCAPING, BICYCLE AND PEDESTRIAN IMPROVEMENTS ON EAST ROSEDALE STREET FROM IH -35W TO U.S. 287; PROVIDING FOR A SEVER.A.BILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grant Capital Projects Fund in the amount of $5,000,000.00, from available funds, to construct on- street parking, landscaping, bicycle and pedestrian improvements on East Rosedale Street from I:H -35W to U.S. 287. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.] 9911 -09 -2011 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached resolution authorizing the execution of a funding Agreement with the Texas Department of Transportation in the amount of $5,000,000.00 for design and construction of East Rosedale streetscape improvements from Interstate 35W to U.S. 287; 2. Authorize acceptance of Regional Toll Revenue Funds in the amount of $4,000,000.00 via the Texas Department of Transportation to be applied towards the project; 3. Authorize the transfer in the amount of $1,000,000.00 from the 2007 Critical Capital Projects Fund to the Grant Capital Projects Fund to be applied towards the City's match; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grant Capital Projects Fund in the amount of $5,000,000.00. DISCUSSION: Execution of this funding Agreement in the amount of $5,000,000.00 allows for State funding participation in design and construction, Funding includes $4,000,000.00 in Regional Toll Revenue funds and $1,000,000.00 in City of Fort Worth 2007 Certificate of Obligation funds. East Rosedale Street from IH- 35W to U.S. 287 is currently a six lane divided arterial. The project will eliminate the two outside lanes in order to provide on- street parking, landscaping, bicycle and pedestrian improvements under a context sensitive approach to enhance the corridor. East Rosedale Street from IH -35W to U.S. 287 is a four lane divided arterial on the City's Master Thoroughfare Plan. The State will send the City of Fort Worth a check in the amount of $800,000.00 no later than 30 days after the start of fiscal year 2013 and a second check in the amount of $3,200,000.00 no later than 30 days after the start of fiscal year 2014 for a total amount of $4,000,000.00. The Transportation and Public Works Department will be responsible for the collection of State funds. This project is located in COUNCIL DISTRICT 8, Mapsco 77K, 77L and 77M.
