PEACH STREET, LOCATED IN THE TRINITY BLUFF ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BETWEEN SAMUELS AVENUE AND BNSF RAILWAY RIGHT OF WAY, CONTAINING APPROXIMATELY 0.466 ACRES OF LAND, PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of E. Peach Street lying on the north side of Lot I R2 in Block 3 of Trinity Bluff Addition, an addition to the City of Fort Worth, Tarrant County, Texas according to the plat thereof recorded in Document No. D209163425 of the Plat Records of Tarrant County, Texas and on the south side of Lot 1R in Block 4 of Trinity Bluff Addition, an addition to the City of Fort Worth, according to the plat thereof recorded in Cabinet B, Slide 3531 of the said Plat Records, and containing approximately 0-466/1000 acres of land more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. Ordinance No. 20481-11-2012 Page 1 of 2 SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Adopt an ordinance vacating a portion of East Peach Street between Harding Street and Samuels Avenue; and 2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (M&C G- 15624). DISCUSSION: Brooks Baker Surveyors, on behalf of Tom Struhs, has requested the vacation of this street to replat it with the adjoining property. The vacation of the street will eliminate an at-grade railroad crossing. East Peach Street will not be closed to vehicular traffic until the agreed upon improvements to the Gounah Street and Cold Springs underpasses have been made. In order to ensure public access along East Peach Street after it is vacated, a temporary access easement for the public will be granted. It will be removed once the improvements to Gounah Street and Cold Springs are accepted. The City Plan Commission recommended approval of this request at its meeting on January 27, 2010. An acceptable replat (FS -012- 104) has been received. The City of Fort Worth originally obtained the above mentioned rights-of-way through the platting process. The City does not own land under or adjacent to the above referenced streets. Since no City funds have been expended to purchase property or easement rights, collection of the fair market value or any portion thereof is recommended by Staff to be waived.
