HomeMy WebLinkAboutOrdinance 20492-11-2012Ordinance No. 20492-11-2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $74,178.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE GENERAL FUND FOR THE PURPOSE OF CONTlN1UlN r THE, CONSERVATION SPECIALIST POSITION IN THE TRANSPORTATION AND PUBLIC WORKS DEPARTMENT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012 -2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $74,178.00, from available funds, for the purpose of transferring said funds to the General Fund for the purpose of continuing the Conservation Specialist position in the Transportation and Public Works Department. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411 -09 -2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Authorize the allocation in the amount of $74,178.00 from Utility Incentive Rebates Deposited into the Special Trust Fund for Fiscal Year 2013 staffing support for the Better Buildings Challenge; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund in the amount of $74,178.00 from available funds; 3. Authorize the transfer in the amount of $74,178.00 from the Special Trust Fund to the General Fund; and 4. Adopt the attached supplemental appropriation ordinance increasing estimated receipts and appropriations in the General Fund in the amount of $74,178.00 from available funds. DISCUSSION: On May 15, 2012, the City Council adopted Resolution No. 4089 -05 -2012 authorizing the City Manager to enter into a community partnership Agreement with the U.S. Department of Energy for its Better Buildings Challenge. The challenge has an internal and external focus on increasing energy efficiency in the City of Fort Worth and will help us achieve our energy conservation goals as established to comply with Senate Bill 898 of the 82nd Legislative Session of 2011, Resolution No. 4130 -06 -2012 (as codified in Texas Health and Safety Code Chapter 388). The Transportation and Public Works (T /PW) department will be managing the Better Buildings Challenge. T /PW has secured utility incentive rebates that were deposited into the Special Trust Fund (FE72) to be used for future resource conservation projects. These funds will be used to fund a former grant position (Conservation Specialist) to provide staffing support to administer the Fort Worth Better Buildings Program to achieve even more energy savings in the future.
