Authorize the Acceptance of a Deed Conveying Fee Simple Interest in Approximately 0.1457 Acre of Land, Being All of Lot 54, Block 1, Pine Tree
Mobile Home Estates No. 2 Addition, with an Address of 11315 Golden Triangle Circle, Fort Worth, Texas, from Tarrant County to the City of Fort
Worth (COUNCIL DISTRICT 4)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the acceptance of a deed conveying fee simple interest in approximately 0.1457 acre of land, being all of Lot 54, Block 1, Pine Tree
Mobile Home Estates No. 2 Addition, with a physical address of 11315 Golden Triangle Circle from Tarrant County to the City of Fort Worth; and
2. Authorize the City Manager or his designee to execute all necessary documents and record the appropriate instrument conveying fee simple
interest in the land to the City of Fort Worth.
DISCUSSION:
The purpose of this Mayor and Council Communication is to accept the conveyance of the land located at 11315 Golden Triangle Circle from
Tarrant County.
On October 13, 2009, Tarrant County purchased the land and improvements located at 11315 Golden Triangle Circle with funding from a Hazard
Mitigation Grant Program administered through FEMA. The purpose of the acquisition was to remove the improvements that were subject to
flooding and convert the land use into perpetual open space. Subsequent to the acquisition and demolition of the improvements Tarrant County
asked the City to accept the conveyance of the property and management of the perpetual open space. A condition of property acceptance is that
it would be at no cost to the City with the exception of required maintenance responsibility.
The property was subject to restrictions and requirements, which include payment of monthly dues and any special assessments, of the
Declaration and Protective Covenants for Pine Tree Estates #2 Landowners Association (LOA) under the Declaration of Planned Urban
Development (Declaration) for the Pine Tree Mobile Homes Estates No. 2 Addition.
An acceptable agreement has been reached with the LOA, subject to final vote by its members, to amend the Declaration prior to the City's
acceptance of the land from Tarrant County and exempt the land from all requirements and restrictions, which includes any land owner payment
obligation for dues or special assessments. Additionally, the LOA is accepting the obligation to mow and maintain the land for a period of twenty-
five (25) years in exchange for the City's payment of $15,000.00.
The property is located in COUNCIL DISTRICT 4.
A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: Tarrant
County
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the Stormwater Capital
Projects Fund SW Minor Repair & Renovation -Easement project to support the approval of the above recommendations and execution of the
conveyance. Prior to any expenditure being incurred, the Transportation & Public Works Department has the responsibility to validate the
availability of funds.
