HomeMy WebLinkAboutOrdinance 16834-02-2006Ordinance No. 1683402-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $83,576 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING MAINTENANCE AT FULI~.ER GARDEN, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES 1N CONFLICT HEREWITH; AND PROVIbING AN EFFECTIVE DATE. BE IT ORbAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for 1=fiscal Year 2DD5- 20D6 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $83,576 frarn available funds far the purpose of funding Maintenance at Fuller Garden. SECTION 2, That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in no way impair the remaining portions, sections, ar parts of sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That Phis ordinance shall be cumulative of Ordinance Na. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Accept a gift from the Fuller Foundation, Inc., in the amount of $83,576.00 for the purpose of maintaining the Fuller Garden for a period of one year; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund by $83,576.00. Dlscussl©N: The Fuller Garden is a three and one-half acre garden located west of the Botanic Garden Center and Conservatory. It was a gift from the Fuller Foundation, Inc., which has underwritten all maintenance costs since the garden opened to the public in 1991. The Foundation has announced a gift of $83,576.00 to the Parks and Community Services Department to fund for one year, the salary and benefits for one Gardener and one Senior Maintenance Worker position, as well as maintenance, supplies, equipment and utilities to maintain the Fuller Garden. The Foundation will continue funding these positions, supplies, equipment and utilities far the maintenance of this garden. The City will collect funds each quarter from the Foundation. The Fort Worth Botanic Garden serves all COUNCIL DISTRICTS and is located in COUNCIL DISTRICT 7. FISCAL INFORMATIONICERTIFICATION: The Finance Director certifies that upon adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Special Trust Fund. The Parks and Community Services department is responsible far the collection and deposit of these funds.
