Authorize the First Renewal of a Professional Services Agreement with Shield Engineering Group, PLLC for Stormwater Capital Project
Management Services and Authorize the First Amendment to the Agreement to Add Additional Funds in the Amount of $2,400,000.00 for a
Revised Contract Amount of $3,500,000.00 (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of the first renewal of City Secretary Contract No. 52582, a professional services agreement with Shield Engineering
Group, PLLC for Capital Project Management Services; and
2. Authorize the First Amendment to City Secretary Contract No. 52582, as renewed, to add additional funds in the amount of $2,400,000.00, for a
revised contract amount of $3,500,000.00.
DISCUSSION:
This Mayor and Council Communication (M&C) will authorize the first renewal of City Secretary Contract No. 52582, a Professional Services
Agreement with Shield Engineering Group, PLLC (Shield) for staff extension services in managing Stormwater Capital Projects and an
amendment for a additional funds in the amount of $2,400,000.00. On June 18, 2019 (M&C C-29150), the City Council approved the original
agreement in an amount not to exceed $1,100,000.00. The contract allowed for additional renewal periods, contingent upon City Council approval,
for the purpose of maintaining continuity and efficiency in the delivery of the Stormwater capital program.
The Stormwater Utility fee increase approved by the City Council in October 2019 made possible a revenue bond sale, anticipated for Fall 2020.
The bond issuance will more than double the Stormwater capital delivery capacity compared to the strictly PayGo funded program of the preceding
years. Projects to be constructed using the revenue bonds include hazardous roadway overtopping mitigation projects, storm drain pipe
rehabilitation projects, drainage system improvements, and channel restoration improvements. Anticipated bond spending for these projects is
reflected in the FY2021-2025 Stormwater Management Capital Improvement Plan.
In May 2018, the Stormwater Management Division published a Request for Qualifications for various technical services associated with drainage
engineering, including capital project management. Shield was selected as the most qualified engineering consultant for this service. Shield is
expected to provide project management services for approximately 55 projects for approximately 18 months. Project management services will
cover stormwater project development, design, construction management, and project closeout. Shield proposes to provide these services in an
amount not to exceed $2,400,000.00. This amended amount is based upon the number of projects included in this timeframe and is in proportion
to the project management costs experienced for the smaller, PayGo funded, Stormwater capital program of the preceding years. The revised
contract amount after this renewal will be $3,500,000.00. It will remain in effect until funds are expended or the work is completed.
M/WBE Office - A waiver of the goal for MBE/SBE subcontracting requirements was requested by the Department and approved by the M/WBE
Office, in accordance with the M/WBE or BIDE Ordinance, because the purchase of goods or services is from sources where subcontracting or
supplier opportunities are negligible.
The projects are located in ALL COUNCIL DISTRICTS.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budgets, as previously appropriated, in the Stormwater Capital
Projects Fund, and funds will be available contingent on the approval of the Fiscal Year 2021 capital budget appropriation in the Stormwater Debt
Capital Project Fund to support the approval of the above recommendation and execution of the amendment. The future funding is anticipated to
be available shortly after October 1, 2020. Prior to any expenditure being incurred, the Transportation & Public Works Department has the
responsibility to validate the availability of funds.
