RECOMMENDATION:
It is recommended that the City Council:
1. Conduct a public hearing under the guidelines set forth by the Texas Parks and Wildlife Code, Chapter 26, Protection of Public Parks and
Recreational Lands;
2. Find that no feasible or prudent alternative exists for the use of Trinity Park for the proposed Rights of Way (ROW) realignment;
3. Find that the proposed intersection improvements include all reasonable planning to minimize harm to the parkland, including that all
infrastructure and equipment will be constructed in Trinity Park as specified on the attached exhibits and as noted in the discussion below;
4. Close the public hearing and authorize the use of approximately 0.246 acres of dedicated parkland at Trinity Park for the proposed intersection
improvements; and
5. Authorize the execution and recording of all necessary documents to complete the conveyance.

DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to authorize the granting of Rights of Way (ROW) in Trinity Park (Park) for the
construction and installation of intersection improvements. In accordance with the Texas Parks and Wildlife Code, Chapter 26, the City of Fort
Worth seeks to convert approximately 0.246 acres of parkland for the purpose of ROW realignment and installing pavement and associated
infrastructure on park property.
The Park & Recreation Department (PARD) was approached by the Transportation and Public Works Department (TPW) requesting the use of a
portion of Trinity Park for road realignment at the intersection of West 7th Street and Museum Way. The project includes roadway, traffic
intersection and signalization improvements and the realignment and addition of sidewalks.
TPW requests authorization to obtain ROW in Trinity Park at the southeast corner of West 7th Street and Museum Way. The project will create a
four way intersection resulting in improved traffic and pedestrian safety. The realigned intersection will also improve traffic flow by reducing vehicle
delays currently experienced at this intersection. The ROW requested is 0.246 acres to accommodate drive lanes and sidewalk. In conjunction
with this project, 4,229.93 square feet (0.097 acres) of existing ROW will be vacated and remain parkland.
The proposed project includes road realignment of approximately 220 feet on Museum Way south of West 7th Street, which will align with Stayton
Street north of West 7th Street upon completion of the project. The realignment was designed to limit the impact to the parkland and improve
safety. Access to the Trinity Park parking lot may be temporarily impacted due to the reconstruction of Museum Way. Any temporary closures of
driveways will be managed through detouring traffic using the surrounding street network.
TPW is working with the City Forester to minimize tree impacts for the project. Trees permitted for removal shall be mitigated on a caliper inch per
inch basis. Mitigation for trees can be made on site or, if not possible or desirable, mitigation into the City Tree Fund will be made in the amount of
$200-$400 per caliper inch for trees not planted. All remaining trees will be protected with tree protection fencing throughout construction. TPW
will restore the park to previous condition or better upon completion.
In accordance with State law, public notice of the hearing was advertised in the Fort Worth Star -Telegram on July 14, 21 and 28, 2020 and August
4, 2020. An exhibit map was available for public review on the PARD website.
Signage was posted at the site noting the proposed use and providing instructions for directing comments to the Park & Recreation Department.
Staff will note any public comment received during the public hearing Report of City Staff.
Trinity Park is located in COUNCIL DISTRICT 9.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
