Ordinance No. 16851-03-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $30,663.50 AND THE SEWER CAPITAL PROJI=CT FUND IN THE AMOUNT OF $17,536.05 FROM AVAIā¬ABLE FUNDS FOR THE PURPOSE OF FUNDING AN ENGINEERING AGREEMENT WITH BROWN AND GAY ENGINEERS, INC. FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER MAIN REPLACEMENT ON BI.,ACKMORE AVENUE (PREVOST STREET TO HERVIE STREET), KILPATRICK AVENUE (ELDRIDGE STREET TO EAST DEAD END) AND KILPATRICK AVENUE (HERVIE STREET TO BOURINE STREET); MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital project Fund in the amount of $30,863.50 and the Sewer Capital Project Fund in the amount of $17,536.05 able funds for the purpose of funding an engineering agreement with Brown and Gay Engineers, Inc. for pavement reconstruction and water and sanitary sewer main replacement on Blackmore Avenue (Prevost Street to Hervie Street}, Kilpatrick Avenue Eldridge (Street to East Dead End} and Kilpatrick Avenue (Hervie Street to Baurine Street}, SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, ar parts of sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That this ordinance shat[ be cumulative of Ordinance Na. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of $48, ~ 99.55 from the Water and Sewer Operating Fund to the Water Capita! Project Fund in the amount of $30,663.50 and Sewer Capital Project Fund in the amount of $17,536.05; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project Fund in the amount of $30,663.50 and the Sewer Capital Project Fund in the amount of $17,538.05, from available funds; and 3. Authorize the City Manager to execute an engineering agreement with Brown and Gay Engineers, Inc., in the amount of $97,577.00 for pavement reconstruction and water and sanitary sewer main replacement on Blackmore Avenue (Prevost Street to Hervie Street), Kilpatrick Avenue (Eldridge Street to East Dead End) and Kilpatrick Avenue (Hervie Street to Bourine Street). ©ISCUSSION: The 2004 Capital Improvement Program (C1P) includes funds for pavement reconstruction and the Water and Sewer Operating Fund includes funds for water and sanitary sewer main replacement on Blackmore Avenue (Prevost Street to Hervie Street), Kilpatrick Avenue (Eldridge Street to East Dead End} and Kilpatrick Avenue (Hervie Street to Bourine Street). This project consists of the preparation of plans and specifications for the replacement of water and sanitary sewer mains and pavement reconstruction on the above identified streets. Brown and Gay Engineers, Inc., proposes to perform the necessary design work for a lump sum fee of $97,577.00. City Staff considers this fee to be fair and reasonable for the scope of services proposed. 1n addition to the contract amount $94,453.75 (water: $3,712.50; sewer: $1,704.05; and streets: $9,037.20) is required for project management by the Engineering Department. Brawn and Gay Engineers, ]nc., is in compliance with the City's M/WBE Ordinance by committing to 19% MNVBE participation. The City's goal an the project is 19%.
