SUSPENDING PORTIONS OF THE FORT WORTH UTILITY CONSTRUCTION POLICY GOVERNING PAVEMENT CUTS AND EXCAVATION AND PAVEMENT REPAIR FOR UTILITY CONSTRUCTION WITHIN THE CITY'S RIGHTS -OF - WAY AND EASEMENTS WHEREAS, the Utility Construction Policy Governing Pavement Cuts and Excavation and Pavement Repair for Utility Construction Within the City's Rights -of - Way and Easements a/k/a the Utility Cut Policy serves as the policy governing pavement cut repairs, was updated and adopted on May 7, 2019 by Resolution No. 5082-05-2019, M&C G-19533; and WHEREAS, the Utility Cut Policy requires certain levels of repair to both concrete and asphalt streets cut for utility construction activities; and WHEREAS, the City has various classifications of streets including: Local (Neighborhood) Streets, Connectors and Arterials as identified in the City's One Address dataset; and WHEREAS, the Utility Cut Policy does not differentiate between the street classifications except with regard to the pavement type; and WHEREAS, due to the impact of the COVID-19 pandemic on the City's budget and the local, state and national economy; the implementation of the pavement surface restoration requirements for local asphalt pavement streets and for surface restoration directly and solely related to installing a new tap or service connections that are on certain asphalt pavement streets place undue hardship on the City and others cutting the streets for utility construction purposes; and WHEREAS, the City desires to suspend the pavement surface restoration requirements established in Section D. 6. of the Utility Cut Policy and establish temporary requirements for all local streets with asphalt pavement through September 30, 2021 as follows: • Removal of the minimum 50' length for pavement surface restoration for streets 2-to 10 years or greater than 85 PCI; and • Removal of the minimum 30' length for pavement surface restoration for streets more than 10 years; and WHEREAS, the City desires to suspend the pavement surface restoration requirements established in Sections D. 6. and D. 8. of the Utility Cut Policy and establish temporary requirements for repairs directly and solely related to installing a new water or wastewater tap or service connection, that have associated fees for service, that are on all local, collector or arterial streets with asphalt pavement through September 30, 2021 as follows: • Reduce rectangular l0xl0 feet surface restoration minimum to the previous 5x5 feet requirement; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: The Utility Cut Policy for the City of Fort Worth is hereby suspended as to the requirements established for all local asphalt pavement street repairs due to utility service construction and for repairs directly and solely related to installing a new water or wastewater tap or service connection, that have associated fees for service, that are on all local, collector or arterial streets with asphalt pavement and establish temporary requirements through September 30, 2021, as follows: • Removal of the minimum 50' length for pavement surface restoration for streets 2-to 10 years or greater than 85 PCI in Sections D.6., resulting in temporary requirement to resurface 1/2 of pavement, curb to centerline for the required length of repair; • Removal of the minimum 30' length for pavement surface restoration for streets more than 10 years in Section D.6., resulting in temporary requirement to overlay one lane width (approximately 12 feet) for the required length of repair ; and • Reduce rectangular l0xl0 feet surface restoration minimum, resulting in temporary requirement of 5x5 feet surface restoration minimum.
