HomeMy WebLinkAbout(0163) M&C 20-0979City of Fort Worth, Mayor and Texas Council Communication DATE: 12/15/20 M&C FILE NUMBER: M&C 20-0979 LOG NAME: 60FORT WORTH-HASLET-TRA SEWER PROJECT-ADDFUNDING SUBJECT (CD 7) Authorize Additional Funding in the Amount of $106,287.79 to the Original Payment to the City of Haslet for the City of Fort Worth's Contractual Obligation Pursuant to City Secretary Contract No. 41774, as Amended, for the First Change Order to the Fort Worth -Haslet -Trinity River Authority Sewer Project for a Total City of Fort Worth Cost of $2,569,544.06 RECOMMENDATION: Authorize Additional Funding in the Amount of $106,287.79 to the Original Payment to the City of Haslet for the City of Fort Worth's Contractual Obligation Pursuant to City Secretary Contract No. 41774, as amended, for the First Change Order to the Fort Worth -Haslet -Trinity River Authority Sewer Project for a Total City of Fort Worth Cost of $2,569,544.06. DISCUSSION: On March 1, 2011, Mayor and Council Communication (M&C PZ-2929), City Council authorized the City Manager to execute an Interlocal Agreement between the Cities of Fort Worth, Haslet, and the Trinity River Authority (TRA). On March 11, 2011, City Secretary Contract No. 41774 was executed which allows either the City of Fort Worth or Haslet to take the initiative to construct wastewater collection mains by proposed developments in either city. The Interlocal Agreement also moved the proposed locations of the future TRA meters to the Fort Worth city limit line. Additionally, the Interlocal Agreement established the future capacity percentage of the TRA wastewater collection per acre adjustment being served in Fort Worth and Haslet. On December 12, 2017 (M&C C-28511), Council approved making amendments to the preliminary cost estimates for the wastewater collection main improvements and cost -sharing percentages between Fort Worth and Haslet. On August 14, 2018, City Secretary Contract No. 41774-A1 was executed. The City of Haslet retained the services of Lockwood Andrews & Newnam to perform the design of the wastewater collection main at a cost of $354,748.00. Bids were opened on September 11, 2019, and the lowest bidder was Acadia Services, LLC at $2,171,496.00. In addition to the design and construction cost, Trinity River Authority has an inspection fee of $115,000.00. A 10% contingency fee of $217,149.59 was also included. The total cost of the project (design, construction, inspection, and contingency) is $2,858,393.59. The costs per the agreement are as follows: Segment "A" 84.45\% City of Fort Worth $1,059,741.04 Segment "B" 83.36\% City of Fort Worth $674,361.25 Segment "C" 91.77\% City of Fort Worth $729,153.98 Total $2,463,256.27 On December 3, 2019 Mayor and Counil Communication (M&C 19-0355), the City Council authorized payment in the amount of $2,463,256.27 to the City of Haslet for the City of Fort Worth's share of the total project costs of the Fort Worth -Haslet -Trinity River Authority Sewer project. During machine tunneling in Segment "A" of the project, previously unknown hard rock and excessive groundwater was encountered which necessitates hand tunneling to install the identified sewer main segment. The additional cost of the change to hand tunneling is $347,270.00 of which Fort Worth's share is $293,269.52 ($347,270.00 x 0.8445). Since the City of Fort Worth had previously transferred a contingency fund in the amount of $186,981.73 to the City of Haslet, the additional funding needed for the change order is $106,287.79. This project is located adjacent to COUNCIL DISTRICT 7, within the City of Haslet. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the recommendations, funds are available in the current operating budget, as appropriated, in the Water & Sewer Fund and that, prior to an expenditure being incurred, the Water and Sewer Department has the responsibility to validate the availability of funds.
