(ALL) Adopt Resolution Temporarily Suspending Portions of the Utility Construction Policy Governing Asphalt Pavement Cuts and Excavation and
Pavement Repair for Utility Construction within City Rights -of -Way and Easements
RECOMMENDATION:
It is recommended that the City Council adopt the attached resolution temporarily suspending portions of the Utility Construction Policy governing
asphalt pavement cuts and excavation and pavement repair for utility construction within the City's rights -of -way and easements and establishing
temporary standards through September 30, 2021.
DISCUSSION:
City staff is recommending that the City Council adopt the attached resolution. The resolution temporarily suspends certain portions of the policy
governing pavement cuts and excavation and pavement repair for utility construction within the City's rights -of -way and easements and within the
Utility Construction Policy. The resolution also establishes temporary standards to be followed until September 30, 2021. The Utility Construction
Policy, adopted May 7, 2019 (M&C G-19533), applies to all pavement cuts or excavations within the City of Fort Worth rights -of -way and
easements to ensure that streets are properly repaired to preserve longevity after utility construction and maintenance cuts. The Utility Constuction
Policy requires certain levels of repair to streets cut for utility construction activities.
Due to the impact of the COVID-19 pandemic on the City's budget and the local, state, and national economy; the implementation of the pavement
resurfacing requirements for local (residential) asphalt pavement streets as well as for repairs directly and solely related to installing a new tap or
service connection, that have associated fees for service, that is on asphalt pavement streets (local, arterial and collector), place undue hardship
on the City and others cutting the streets for utility construction.
The City desires to suspend the pavement restoration requirements established in Section D. 6. of the Utility Construction Policy for all local
(residential) streets with asphalt pavement and to suspend the pavement resurfacing requirements established in Sections D. 6. and D. 8. of the
Utility Construction Policy for repairs directly and solely related to installing new water or wastewater tap or service connection, that have
associated fees for service, that is on all local, collector or arterial streets with asphalt pavement and establish temporary requirements through
September 30, 2021 as follows:
• Removal of the minimum 50' length for pavement surface restoration for streets two to ten years or greater than 85 PCI for local (residential)
streets, resulting in temporary requirements to resurface 1/2 of pavement, curb to centerline for the required length of repair;
• Removal of the minimum 30' length for pavement surface restoration for streets more than ten years for local (residential) streets, resulting in
temporary requirement to overlay one lane width (approximately 12 feet) for the required length of repair; and
• Reduce rectangular 10x10 feet surface restoration minimum, resulting in temporary requirement of 5x5 feet surface restoration minimum.
All other requirements detailed in the 2019 Utility Construction Policy will remain in effect.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.

The Director of Finance certifies that approval of this recommendation will have no material effect on City funds.
