Authorize execution of a contract with 2L Construction LLC, in the amount of $892,065.00 for construction of sidewalks along Miller Avenue from Mansfield Highway to Chickasaw Avenue (City Project No. 100637); 2. Adopt the attached appropriation ordinance adjusting appropriations in the 2018 Bond Program Fund by increasing appropriations in the Sidewalks FY2017 project (City Project No. 100637) in the amount of $892,065.00, and decreasing appropriations in the Sidewalks and Bicycle Lanes programmable project (City Project No. PB0002) by the same amount; and 3. Amend the FY2021-2025 Capital Improvement Program. DISCUSSION: This Mayor and Council Communication (M&C) is to authorize a construction contract for sidewalk improvements that consists of approximately 10,500 linear feet of concrete sidewalk and 41 Americans with Disabilities Act barrier free ramps along Miller Avenue from Mansfield Highway to Chickasaw Avenue. The project was advertised for bid in the Fort Worth Star -Telegram on September 10, 2020 and September 17, 2020. On October 8, 2020 the following bids were received: Bidders Amount Time of Completion Cole Construction* $786,998.00 2L Construction, LLC $892,065.00180 Calendar Days Greeniverse Construction $943,966.67 Northstar Construction $1,062,277.00 MHB Construction $1,078,043.00 Reyes Group, Ltd $1,090,812.00 North Rock Construction, LLC $1,249,184.27 FNH Construction, LLC $1,367,590.00 *Cole Construction bid has been determined to be non -responsive due to the fact that they did not acknowledge Addendum #1, which revised the bid form, and thus utilized the incorrect bid form in their bid. M/WBE OFFICE- 2L Construction, LLC is in compliance with the City's BDE Ordinance by committing to 11% MBE participation and documenting good faith effort. 2L Construction, LLC identified several subcontracting and supplier opportunities. However, the firms contacted in the areas identified did not respond or did not submit the lowest bids. The City's MBE goal on this project is 16%. This project is included in the 2018 Bond Program. Available resources within the General Fund will be used to provide interim financing until debt is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance No. 23209-05-2018) and subsequent actions taken by the Mayor and Council. The 2018 Bond Program funding was included in the 2021-2025 Capital Improvement Program for programmable project Sidewalks and Bicycle Lanes (City Project No. PB0002). In order to administratively track the spending of all funding sources in one project, appropriation ordinances are needed to move appropriations from the programmable project to the jointly funded static project. This action will amend the 2021-2025 Capital Improvement Program as approved in connection with Ordinance 24446-09-2020. This project will have no impact on the Transportation and Public Works annual operation budget when completed This sidewalk project is located in COUNCIL DISTRICTS 5 and 8. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Sidewalks/Bicycle Lanes programmable project within the 2018 Bond Program Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the 2018 Bond Program Fund for the Sidewalks FY2017 project to support the approval of the above recommendations and execution of the contract.
