Authorize the Waiver of All Development Fees Estimated at $6,111.00 for the $621,000.00 in Remodeling Construction Being Donated to the Fort
Worth Community Arts Center by Kids Who Care Inc. and Find that the Waiver of Such Fees Serves a Public Purpose (COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the waiver of all development fees, which is estimated at $6,111.00, for the $621,000.00 in remodeling construction being
donated for improvements to the Fort Worth Community Arts Center by Kids Who Care, Inc.; and
2. Find that the waiver of such fees serves to carry out the public purpose of improving City property with privately -donated funds and that
adequate controls are in place to carry out such public purpose.
DISCUSSION:
The City -owned Fort Worth Community Arts Center (FWCAC), which is located at 1300 Gendy Street, is scheduled to undergo construction for a
new modern rehearsal room and associated classrooms in the lower level. The total project costs, including design and construction, is estimated
at $750,000.00. Kids Who Care, Inc., which is a nonprofit international theater company that produces creative and confident kids through musical
theater exposure, education, and experience, has generously agreed to donate $621,000.00 towards completion of the project. Staff will bring
back a future Mayor and Council Communication addressing the actual construction of the improvements.
The City collects certain permit and inspection fees for the review of construction plans and the inspection of construction. Staff recommends that
the City Council waive all development fees related to this project that would otherwise be charged by the City, including, without limitation, the
following: (1) all building permit, plan review, inspection, and re -inspection fees, (ii) all zoning fees, (iii) all temporary encroachment fees, (iv) all
platting fees, (v) all fire, sprinkler, and alarm permit fees, and (vi) electrical and mechanical fees.
The fees to be assessed for the renovation of the FWCAC are approximately $6,111.00 for the $621,000.00 in remodeling construction being
donated for the project by Kids Who Care. The fee waivers will serve the public purpose of improving City property with privately -donated funds,
and the City will ensure that adequate controls are in place to carry out such public purpose through its permitting and inspection process.
The Community Arts Center is located in COUNCIL DISTRICT 7.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that this action will have no material effect on City funds.
