Report of City Staff: Richard Zavala; b. Public Comment; c. Council Action: Close Public Hearing and Act on M&C) RECOMMENDATION: It is recommended that the City Council: 1. Conduct a public hearing under the guidelines set forth by the Texas Parks and Wildlife Code, Chapter 26, Protection of Public Parks and Recreational Lands; 2. Find that no feasible or prudent alternative exists for the use of Diamond Hill Park for the proposed location of water line and maintenance area for water line; 3. Find that the proposed water line relocation includes all reasonable planning to minimize harm to the parkland, including that all infrastructure and equipment will be constructed and located in Diamond Hill Park as specified on the attached exhibits and as noted in the discussion below; 4. Close the public hearing and authorize the use of approximately 0.185 acres of dedicated parkland at Diamond Hill Park for the proposed new 12-inch water line and 15-foot wide maintenance area; and 5. Authorize the execution and recording of all necessary documents to complete the conveyance. • Diamond HIII Park - located at 3709 Weber Street, North of NE 36th Street, South of NE 37th Street, West of Hardy Street, and East of Weber Street. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize the granting of a maintenance area at Diamond Hill Park (Park) for the purpose of installing a water line. The 2018 Bond Program includes the replacement of the Diamond Hill Community Center. The new building location conflicts with an existing water line. A portion of the existing water line will be abandoned in place and a new water line will be routed around the new building. Approximately 240 linear feet of existing 12-inch water line will be abandoned and the new 12-inch water line will be rerouted around the proposed new building located within Diamond Hill Park. The existing and proposed 12-inch water line provides domestic and fire service to the Community Center and surrounding neighborhood. The proposed water line will be located under the drive lane to reduce the impact to the park. As designed the line would be approximately 536 feet long and 15 feet wide to accommodate a required maintenance area equating to approximately 8,047 square feet or 0.185 acres of Maintenance Area on parkland. When completed, this improvement will have no impact on either the Transportation & Public Works Department or the Park & Recreation Department's annual operating budget. In accordance with the Texas Parks and Wildlife Code, Chapter 26, the City of Fort Worth seeks to convert approximately 0.185 acres of parkland for the purpose of installing a 12-inch water line in a 15-foot wide maintenance area on park property. In accordance with State law, public notice of the hearing was advertised in the Fort Worth Star -Telegram on July 28, 2020, August 4, 2020 and August 11, 2020. On July 22, 2020, an announcement was made available for public review on the Park & Recreation Department website in an alert box at the top of page. An email notification announcing the proposed use was sent to the president of the Diamond Hill Jarvis Neighborhood Association on July 2, 2020. Signage was posted at the site noting the proposed non -recreational use and providing instructions for directing comments to the Park & Recreation Department. Staff will note any public comment received during the public hearing Report of City Staff. Diamond Hill Park is located in COUNCIL DISTRICT 2.
