Adopt the attached Resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation (TxDOT) in the amount of $1,440,539.00 with Federal participation in the amount of $723,205.00, State participation in the amount of $59,109.00, and Local participation in the amount of $658,225.00 for the McCart Avenue and Altamesa Boulevard project (TxDOT Control Section Job No. 0902-90-119, 0902-90-192); 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund, subject to receipt of the grant, in the amount up to $803,561.00 for the McCart Ave & Altamesa Blvd project (City Project No. 101572); 3. Authorize payment to the Texas Department of Transportation in the amount of $249,463.00 for the McCart Avenue and Altamesa Boulevard project (City Project No. 101572); and 4. Amend the FY 2021-2025 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to adopt a resolution authorizing execution of an Advance Funding Agreement (AFA) (Control Section Job No. 0902-90-119, 0902-90-192) for this Highway Safety Improvement Program (HSIP) project with the Texas Department of Transportation (TxDOT) and accept the federal grant funds for the construction in the amount not -to -exceed $723,205.00. After submitting this intersection for HSIP consideration, it was selected to receive federal funds. The project includes pedestrian safety and traffic signal improvements as well as pavement reconstruction of left -turn lanes to increase capacity. The intersection improvements will provide orderly movement of traffic through the intersection while increasing safety for pedestrians and vehicles. Since this is a HSIP project, TxDOT will be letting the construction. They will absorb the indirect cost for providing statewide support services to this federally funded project in the amount of $59,109.00. For this AFA, a 90% (federal) to 10% (local) match is required. Consequently, the federal and local participation of the grant component are $723,205.00 and $80,356.00, respectively. In addition to the local participation, the City will provide $577,869.00 (available from M&C G-19306 2018 Bond Program) towards the AFA for engineering, environmental, and construction as well as to cover additional City scope items identified during the preliminary engineering phase of this project. Before the start of construction, an advanced payment to TxDOT is required in the amount of $249,463.00. The final payment to TxDOT for local participation will be based on actual costs. Available resources within the General Fund will be used to provide interim financing until debt is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance No. 23209-05-2018) and subsequent actions taken by the Mayor and Council. Construction is anticipated to start in August 2021 and finish August 2022. Funding for this project was not included in the FY2021-2025 Capital Improvement Program due to the approval for federal Highway Safety Improvement Program (HSIP) funds. The action in this M&C will amend the FY2021-2025 Capital Improvement Program as approved in connection with Ordinance 24446-09-2020. This project is located in COUNCIL DISTRICT 6. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: Texas Department of Transportation FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, in the Grants Cap Projects Federal Fund. The Transportation and Public Works Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City.
