(CD 5) Authorize Execution of a Public Right -of -Way Use Agreement Granting Sage Natural Resources, L.L.C., a License to Construct and
Operate a Twelve -Inch Natural Gas Gathering Pipeline Across South Cravens Road, North of Elizabeth Road
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute a public right-of-way use agreement with Sage Natural Resources,
L.L.C., for a one-time license fee in the amount of $4,197.60 and granting a license to construct and operate a twelve -inch natural gas gathering
pipeline across South Cravens Road, north of Elizabeth Road. (GP20-00004)
DISCUSSION:
Sage Natural Resources, L.L.C., is constructing a twelve -inch pipeline to connect natural gas wells in Fort Worth. With the exception of the private
property easements on the east and west ends of this constructible segment, the pipeline will be located in public easements. The approximate
location of the crossing is shown on the attached map.
The Transportation and Public Works Department has reviewed the proposed crossing and has no objections. The pipeline on either side of the
crossing is not running through residentially zoned and used property.
The public right-of-way use agreement will give Sage Natural Resources, L.L.C., a license to use 72 feet of that specific public right-of-way for the
limited purpose of operating a natural gas pipeline for a period of 25 years. Sage Natural Resources, L.L.C., will pay the City a one-time license
fee of $4,197.60 in return for this privilege. The company will be required to provide bonds and insurance in accordance with the City's current
standard policies. Because Sage Natural Resources, L.L.C., is not a public utility, as that term is defined in Chapter 28 of the City Code, a
franchise governing its operations is not required by the City Charter.
The crossing is located in COUNCIL DISTRICT 5.
A Form 1295 is not required because: This contract legally does not require City Council approval.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendation(s) and execution of the agreement, funds will be deposited into
the General Fund. The Development Services Department (and Financial Management Services) is responsible for the collection and deposit of
funds due to the City.
