ordinance No. 16886T04-20x6 AN ORDINANCE INCREASING ESTIMATED RECEIPTS ANb APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $119,248 ANb THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $442,7D6 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT WITH MCCLENDON CONSTRUCTION CO., INC. FOR PAVEMENT RECONSTRUCTION AND -WATER AND SANITARY SEWER MAIN REPLACEMENT ON PIEDMONT ROAD FROM TRAPPINGHAM TERRACE TO SOUTHWEST BOULEVARD AND CRESTON AVENUE FROM STADIUM DRIVE TO WESTCREEK DRIVE {PROJECT NO. 00016); MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE 17ATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2DD6 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $119,248 and the Sewer Capital Projects Fund in the amount of $442,706 from available funds for the purpose of funding a contract with McClendon Construction Co., Inc. for Pavement Reconstruction and Water and Sanitary Sewer Main Replacement on Piedmont Road from Trappingham Terrace to Southwest Boulevard and Creston Avenue from Stadium Drive to Westcreek Drive (Project Na. DDD16). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer of $561,954.00 from the Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of $119,248.00 and Sewer Capital Projects Fund in the amount of $442,7a6.oo; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $119,248.00 and the Sewer Capital Projects Fund in the amount of $442,706.00, from available funds; and 3. Authorize the City Manager to execute a contract with McClendon Construction Cn., Inc., in the amount of $925,800.00 for Pavement Reconstruction and Water and Sanitary Sewer Main Replacement an Piedmont Road from Trappingham Terrace to Southwest Boulevard and Creston Avenue from Stadium ©rive to Westcreek Drive. {Project No. 00018). ©ISCUSSI®N. On September 14, 2004, {M&C C-20272) the City Council authorized the City Manager to execute an engineering agreement with CLR, Inc., for pavement reconstruction and water and sanitary sewer main replacement on Piedmont Road from Trappingham Terrace to Southwest Boulevard and Creston Avenue from Stadium Drive to Westcreek Drive (DOE 4569). The 2004 Capital Improvement Program (CIP) includes funds for pavement reconstructian and the Water and Sewer Operating fund includes funds for water and sanitary sewer replacements on all streets mentioned above. Street improvements include pavement reconstruction, construction of standard concrete curb and gutter and driveway approaches as indicated on the plans. The Water Department has determined that severely deteriorated water and sanitary sewer lines should be replaced prior to street reconstruction. The project was advertised on November 17, 2005 and November 23, 2005. Wilson, lnc. $1,269,785.00 $1,214,57(}.00 Time of Completion: 120 Working Days Bids were received on two alternates: a Alternate "A" consists of a 6-inch hot mix asphalt concrete (HMAC) over 8-inch lime stabilized subgrade with 7-inch cancrete curb and 18-inch gutter. ~ Alternate "B" consists of a 6-inch cancrete aver 6-inch lime stabilized subgrade with 7-inch concrete curb. After reviewing all bid proposals, staff recommends Alternate "B" (concrete) far construction since the use of concrete will result in less maintenance cast over the street's useful Life and the bid amount for concrete pavement is lower than the asphalt pavement. Funding in the amount of $49,758.00 is included for associated water and sewer construction survey, project management, pre-construction, material testing, inspection and project close out {water $13,334AOand sewer $28,424.00). The contingency funds to cover change orders total $24,772.00 {water $5,044.00 and sewer $'19,728). Funding in the amount of $40,532.00 is required for associated paving and drainage construction survey, project management, pre-construction, material testing, inspection and project close out. The contingency fund for possible change orders for paving and drainage improvements is $29,519.00 M/WBE -- McClendon Construction Co., lnc., is in compliance with the City`s M/WBE Ordinance by committing to 9% M/WBE participation and documenting good faith effort. McClendon Construction Co., fnc., identified several subcontracting and supplier opportunities. However, the M/WBF's contacted in the areas identified did not submit the lowest bids. The City's goal on this project is 21%. This project is located in COUNCIL DISTRICT 3, Mapsco 74 S and W; 90N. FISCAL IIVFORMATIONICERTIFICATIOId. The Finance Director certifies that upon approval and completion of recommendation 1, and the adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Water Capital Projects l=and, the Sewer Capital Projects l=and and the Street Improvements Fund.
