Accept funding in the amount up to $18,500,000.00 from the Tax Increment Reinvestment Zone No. 14 - Trinity Lakes Fund for the Trinity Boulevard Improvements project; 2. Authorize the execution of an engineering services agreement with Kimley-Horn and Associates, Inc. in an amount not to exceed $366,085.00 for the design of Trinity Boulevard Phase 1 - Interstate Highway 820 to Salado Trail; 3. Adopt the attached appropriation ordinance increasing the receipts and appropriations in the Tax Increment Reinvestment Zone - General Capital Fund in an amount up to $1,000,000.00 transferred from the Tax Increment Reinvestment Zone No. 14 - Trinity Lakes Fund, for the Trinity Boulevard Improvements project (City Project No. 102101); 4. Adopt the attached appropriation ordinance adjusting appropriations in the General Capital Projects Fund by decreasing receipts and appropriations in the Contract Street Maintenance project (P00020) by $290,000.00, and increasing receipts and appropriations in the Trinity Blvd. - 820-Salado Ph1 project by the same amount; and 5. Amend the FY2021-2025 Capital Improvement Program. DISCUSSION: On December 15, 2020, City Council authorized execution of a Tax Increment Financing (TIF) development agreement with the Tax Increment Reinvestment Zone No. 14 - Trinity Lakes to fund construction of infrastructure improvements along Trinity Boulevard in an amount up to $18,500,000.00 (Mayor & Council Communication (M&C) 20-0939). Trinity Blvd. - 820-Salado Ph1 (City Project No. 102101) was included in the Trinity Lakes TIF Project and Financing Plan, and the TIF Development Agreement authorized by Council. This M&C seeks authorization by Council for execution of a Professional Engineering Services Agreement with Kimley Horn and Associates, Inc. in an amount not to exceed $366,085.00 for the design of Trinity Boulevard Phase 1 - IH 820 to Salado Trail. The agreement will supplement Task Order No. 29 out of the On -Call Services contract, City Secretary Contract No. 51285, in the amount of $190,000.00, which was issued to Kimley Horn and Associates, Inc. on December 17, 2020 to expedite the design activities of the fast track project. The agreement will allow Kimley Horn and Associates, Inc. to finalize construction documents for Trinity Blvd. - 820-Salado Ph1. The project contemplates the reconstruction of the existing Trinity Boulevard roadway to a four -lane divided concrete thoroughfare, with a roundabout at the future Trinity Station Way, traffic signals, drainage, street lights and shared use paths. Construction documents were designed by Kimley Horn and Associates, Inc. in 2017 under contract by the Trinity Lakes developer. Recently, the City decided to take on the project and construct it using City funds. The construction documents will need to be updated to meet current City standards. Work under this agreement consists of project management, topographic survey, SUE, permitting, final design plans, specifications, opinion of probable construction costs, bidding and construction phase services. Approval of this M&C will allow the City to enter into that agreement and complete the project. Kimley-Horn and Associates, Inc. proposes to provide the design and construction administration services for a fee of $366,085.00. Staff considers the proposed fee to be fair and reasonable for the scope of services proposed. Approval of recommendation 4 would adjust appropriations between a programmable project and convert the Trinity Blvd. - 820-Salado Ph into a static capital project. This action is needed as future funding for the Trinity Blvd-820 to Thames project (Phase 2) is anticipated from Tax Increment Reinvestment Zone and future bond funds and the scope of this project differs from that of the current programmable project. Funding for this project was not included in the FY2021-2025 Capital Improvement Program (CIP) due to project inception after the adoption of the CIP. The action in this M&C will amend the FY2021-2025 Capital Improvement Program as approved in connection with Ordinance 24446-09- 2020. Kimley-Horn and Associates, Inc. is in compliance with the City's BIDE Ordinance by committing to 3% SBE participation on this project. The project is located in COUNCIL DISTRICT 5. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds, upon approval of the above recommendations and adoption of the attached appropriation ordinances, will be available in the TIRZ #14 — Trinity Lakes Fund and General Capital Projects Fund, for the Trinity Blvd. - 820-Salado Ph1 project to support the approval of the above recommendations and execution of the agreement. Prior to an expenditure being incurred, the Transportation & Public Works Department has the responsibility of verifying the availability of funds.
