(CD 9) Authorize Change Order No. 1 to 2021 Rosemont Area Rehabilitation Contract with Advanced Paving Acquisition, Ltd. to Replace Two
Street Segments Due to Utility Conflicts, Adopt Appropriation Ordinance and Amend the FY2021-2025 Capital Improvement Program
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Change Order No. 1 to City Secretary Contract No. 55137 with Advanced Paving Acquisition, Ltd. to replace two
street segments due to utility conflicts;
2. Adopt the attached appropriation ordinance adjusting receipts and appropriations in the General Capital Projects Fund by decreasing
receipts and appropriations in the Rosemont Transportation and Public Works Streets and Sidewalk project (City Project No. 102661) in the
amount of $299,410.00 and increasing receipts and appropriations in the Rosemont Area Rehabilitation project (City Project No. 102885)
by the same amount; and
3. Amend the FY2021-2025 Capital Improvement Program.
DISCUSSION:
This Mayor and Council Communication (M&C) will move funds of $299,410.00 from Rosemont Transportation and Public Works Streets and
Sidewalk project (City Project No. 102661) to Rosemont Area Rehabilitation project (City Project No. 102885) to cover testing, inspection, and
project administration costs. City's Neighborhood Services is the project sponsor. On December 15, 2020, by M&C 20-0948, the City Council
authorized the execution of a contract with Advanced Paving Acquisition, Ltd. in the amount of $1,561,640.00 for the Rosemont Area
Rehabilitation project. In that M&C, construction costs were appropriated, however, the project soft costs were not concurrently considered.
This M&C will also authorize Change Order No. 1 to replace two street segments in the Rosemont Area Rehabilitation contract. This contract
originally included five street segments. Due to utility work that needs to be completed prior to rehabilitation, two street segments are now
recommended for removal from this contract and replaced with two street segments not in the original project scope as shown in the table below.
The value of the contract and the quantity of work anticipated to be performed is approximately the same as originally contemplated. No additional
funding is required for this change order.

Upon completion of the project, there will be no anticipated impact on the General Fund operating budget.
The General Capital funding was included in the 2021-2025 Capital Improvement Program. In order to move appropriations from one
programmable parent project to other programmable parent projects, new appropriation ordinances are required. This action will amend the 2021-
2025 Capital Improvement Program as approved in connection with Ordinance 24446-09-2020.
This project is located in COUNCIL DISTRICT 9.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the RM 20-TPW Streets/Sidewalks project within the General Capital Projects
Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the
General Capital Projects Fund for the 2021 HMAC -Rosemont Area project to support the approval of the above recommendations and execution
of change order. Prior to an expenditure being incurred, the Transportation & Public Works Department has the responsibility of verifying the
availability of funds.
