HomeMy WebLinkAbout(0051) M&C 21-0248City of Fort Worth, Texas Mayor and Council Communication DATE: 04/06/21 M&C FILE NUMBER: M&C 21-0248 LOG NAME: 21 SPRINT ROLLING HILLS TOWER AMENDMENT SUBJECT (CD 8) Authorize the Execution of the First Amendment to the Communications Tower License Agreement with Sprint Spectrum Realty Company, L.P., for the Licensed Use of Space on the City of Fort Worth's Rolling Hills Radio Tower Located at 2500 Southeast Loop 820 East, Fort Worth, Texas 76106 to Increase the Renewal Term Length and Establish Annual License Fees for First and Subsequent Antennae and Establish a Late Fee Interest Rate RECOMMENDATION: It is recommended that the City Council authorize the execution of the first amendment to the Communications Tower License Agreement with Sprint Spectrum Realty Company, L.P., for the licensed use of space on the City of Fort Worth's Rolling Hills Radio Tower located at 2500 Southeast Loop 820 East, Fort Worth, Texas 76106 to increase the renewal term length and establish annual license fees for first and subsequent antennae and establish a late fee interest rate. DISCUSSION: The City of Fort Worth (City) occasionally licenses space on its radio communications towers when that space is not required for public safety services. Sprint Spectrum Realty Company, L. P. (Sprint) currently has a Communications Tower License Agreement (Agreement) with the City (City Secretary Contract number 47308) for use of space at the Rolling Hills Radio Tower. The initial term of the Agreement expired December 7, 2020 and provides for two (2) consecutive five (5) year renewal options after the initial term expires. The City and Sprint have agreed to amend the Agreement as follow: 1. The two (2) five (5) year renewal terms are changed to two (2) ten (10) years renewal terms; and 2. Establish an annual license fee each year during the renewal terms for $27,220.00 for the first antennae and $2,722.00 for each subsequent antenna place or installed on the premises; and 3. Establish an annual license fee due date each year during the renewal term to December 8th; and 4. The late fee interest rate is changed to 10% per month. This property is located in City Council District 8. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendation and execution of the first amendment of the agreement, funds will be deposited into the General Fund.
