Attached Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Accept a donation in the amount of $33,000.00 from the National Cutting Horse Association Charities Foundation for maintenance and
conservation of a sculpture titled "Buster Welch and King Ranch's Little Peppy" at the Will Rogers Memorial Center; and,
2. Adopt attached appropriation ordinance increasing appropriations in the Special Donations Capital Project Fund in the amount of
$33,000.00, from the National Cutting Horse Association Charities Foundation, for the purpose of funding the FWPA Collection Management
programmable project (City Project No. P00056).
DISCUSSION:
On December 17, 2019, Mayor and Council Communication (M&C 19-0396), City Council authorized acceptance of a bronze sculpture titled
"Buster Welch and King Ranch's Little Peppy" by artist Kelly Graham, along with site enhancements, collectively valued at $250,000.00, for
accession into the Fort Worth Public Art Community Legacy Collection from the National Cutting Horse Association Charities Foundation through
a deed of gift to be executed after its installation at gate 42 of the Will Rogers Memorial Center, 3401 West Lancaster Avenue, 76107. The
sculpture was installed on November 13, 2020.
M&C 19-0396 states that the deed of gift would specify the means by which the donor intends to contribute to the cost for maintenance and
conservation of the sculpture after installation. The National Cutting Horse Association Charities Foundation has offered to make a cash
contribution equal to 15% of the value of the artwork in three (3) annual installments for a total of $33,000.00 upon execution of the deed of gift.
Upon approval of this M&C, the deed of gift will be executed and the first and subsequent installments will be appropriated to the Special
Donations Capital Projects Fund in Fort Worth Public Art (FWPA) Collection Management project which provides for the maintenance of the city's
public art assets.
The Fort Worth Public Art Master Plan Update approved by Council on October 17, 2018 (MC G-19140) outlines the Gifts & Loans Policy
(Appendix 4.f.) and sets the terms for Collection Maintenance (VI.9).

This artwork is located in COUNCIL DISTRICT 7 but serves the entire City.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations, acceptance of the donation, and adoption of the attached
appropriation ordinance, funds will be deposited into the Special Donations Capital Projects Fund. The Planning & Data Analytics
Department (and Financial Management Services) is responsible for the collection and deposit of funds due to the City. Prior to any expense
being incurred, the Planning & Data Analytics Department also have the responsibility to validate the availability of funds.
