HomeMy WebLinkAbout2012/12/04-Minutes-City Council-Executive SessionCITY OF FORT WORTH, TEXAS SPECIAL CITY COUNCIL MEETING CLOSED EXECUTIVE SESSION DECEMBER 04, 2012 After proper notice given pursuant to the Texas Open Meetings Act, Mayor Price adjourned the Council meeting of the Fort Worth City Council at 4:25 p.m. on Tuesday, December 04, 2012, to convene into the Special City Council Meeting for the closed Executive Session in the Pre - Council Chamber of the Fort Worth Municipal Building. Present: Mayor Betsy Price Mayor Pro tem W. B. "Zim" Zimmerman, District 3 Council Member Salvador Espino, District 2 Council Member Daniel Scarth, District 4 Council Member Frank Moss, District 5 Council Member Jungus Jordan, District 6 Council Member Dennis Shingleton, District 7 Council Member Kelly Allen Gray, District 8 (left the meeting at 5:25 p.m.) Absent: Council Member Joel Burns, District 9 (arrived at 5:43 p.m.) Staff Present: Tom Higgins, City Manager Sarah Fullenwider, City Attorney Mary J. Randall Harwood, Planning/Development Director Laetitia Brown, Sr. Assistant City Attorney Chris Trout, Sr. Assistant City Attorney Dee Kelly Jr. (Kelly, Hart and Hallman) Melinda Ramos, Senior Assistant City Attorney Dana Burghdoff, Planning/Development Deputy Director Jocelyn Murphy, Planning Manager CITY OF FORT WORTH, TEXAS SPECIAL CITY COUNCIL MEETING DECEMBER 04, 2012 PAGE 2 of 2 With a quorum of the City Council Members present, the Fort Worth City Council convened into closed Executive Session at 4:25 p.m. on Tuesday, December 04, 2012, in the Pre - Council Chamber of the Fort Worth Municipal Building to discuss matters pertaining to the following: 1. Seek the advice of its attorneys concerning the following pending or contemplated litigation or other matters that are exempt from public disclosure under Article X, Section 9 of the Texas State Bar Rules and as authorized by Section 551.071 of the Texas Government Code: A. Schorn v. City of Fort Worth, Cause No. 48- 245325 -10, Tarrant County, Texas; B. Trevino v. City of Fort Worth, Cause No. 4:12 -CV- 717 -A, United States District Court, Northern District of Texas, Fort Worth Division; C. In Re: 1701 Commerce, LLC. (Sheraton Bankruptcy), Case No. 12- 41748, Northern District of Texas Bankruptcy Court; D. Legal issues related to commuter rail initiatives and public transit services; E. Richard van Houten, Jr. and Stephen Hall v. City of Fort Worth, a Texas Municipal Corporation, Cause No. 4:12 -CV- 00826 -Y, United States District Court, Northern District of Texas; F. City of Fort Worth vs. Employees' Retirement Fund of the City of Fort Worth, Civil Action No. 4:12 -CV- 00829 -A, United States District Court, Northern District of Texas; and G. Legal issues concerning any item listed on today's City Council meeting agendas. 2. Deliberate the purchase, exchange, lease or value of real property in accordance with Section 551.072 of the Texas Government Code. Deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third party; and 3. Deliberate economic development negotiations as authorized by Section 551.087 of the Texas Government Code; and 4. Deliberate the deployment, or specific occasions for implementation, of security personnel or devices, in accordance with Section 551.076 of the Texas Government Code. Council Member Burns arrived at 5:43 p.m. There was no formal action taken by the City Council on the items discussed during the Executive Session and with no further business to be conducted, Mayor Price adjourned the meeting at 5:46 p.m. on Tuesday, December 04, 2012.
