AN ORDINANCE ADDING ONE POSITION IN THE ENGINEER
CLASSIFICATION; REMOVING ONE POSITION IN THE
FIREFIGHTER CLASSIFICATION; ADJUSTING THE TOTAL
NUMBER OF AUTHORIZED POSITIONS AT EACH CLASSIFICATION
(RANK) IN THE FIRE DEPARTMENT FOR FISCAL YEAR 2012-2013;
PROVIDING FOR ADOPTION BY REFERENCE OF A STATEMENT OF
INTENT AND PURPOSE IN ADOPTING THIS ORDINANCE;
PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING
A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT HEREBY KNOWN:
WHEREAS, pursuant to Chapter 143.02 1 (a), Texas Local Government Code, the City
Council may prescribe and/or adjust the authorized number of positions in each classification
(rank) by ordinance;
WHEREAS, on June 7, 2011, the City Council adopted Ordinance.] 9708-06-2011,
which established the Fire Department's sworn personnel staffing levels, effective June 7, 2011,
as follows:

WHEREAS, to create a clear chain of command when a Captain is absent, the City
Council desires to add one position in the Engineer classification, remove one position in the
Firefighter position, and adjust the total number of authorized position at each classification
(rank) in the Fire Department.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That, effective immediately upon the adoption of this ordinance, the following positions
shall be the only positions in each classification (rank) authorized in the City of Fort Worth Fire
Department for the remainder of the Fiscal Year 2012-2013, or until modified by subsequent
ordinance:

SECTION 4.
The Mayor and Council Communication ("M & C") that is presented contemporaneously
with this ordinance is hereby expressly incorporated herein by reference for fin-ther clarification
and explanation of the purposes and intent of the Council in their adoption of this ordinance.
SECTION 5.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinances and such Code, in which event conflicting
provisions of such ordinances and such Code are hereby repealed.
SECTION 6.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not
effect any of the remaining phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional ph-rase, clause, sentence, paragraph
or section.
SECTION 7.
This ordinance shall take effect upon passage.

Adopt Ordinance Increasing the Number of Authorized Engineer Positions by One and Reducing the
RECOMMENDATION: Number of Authorized Firefighter Positions by One in the Fire Department (ALL COUNCIL DISTRICTS)
|tk5 recommended that the City Council adopt the attached ordinance prescribing the number Of
authorized sworn positions iD each classification inthe Fire Department, increasing the number Of
authorized Engineer p0SiUVOS by one and reducing the number 0fauthorized Firefighters by one.
DISCUSSION:
The Fire Department's Supply Section iS staffed with one Fire Captain and two Firefighter positions along
with four non-sworn employees. Fire Supply provides 8VVid8 array Ofitems that fire station needs to
operate. The sworn and general employees have distinctly different duties but both groups fall under the
supervision Ofthe Fire Captain pOSidVO.
The Fire Department operates within a hierarchy based on the chain of command. There is no clear chain
of cD[Onn8nd when the Captain is 3bS8mk. One civilian position is C|aSSUied as 8 Parts and Material
Supervisor. However, civilians can not direct the activities Of civil service personnel as mandated byLocal
Government Code Chapter 143. Firefighters cannot act up more than one n8nh preventing them from
acting in a Fire Lieutenant supervisory pOS|hOn. This void often leads to o delay in decisions during the
Captain's absence and may at times result ina lack Of critical direction.
The reclassification Of one Supply Firefighter position 0OFire Engineer will allow that Engineer 0D "act up"
as a Lieutenant when the Captain is absent, This will allow for a clear chain of command.
The C|asgifiC8dOn change VvOu|d be implemented as foUOvvS: 8 v8Card firefighter position will be deleted
and a Fire Engineer position added; a Firefighter will be promoted into the newly created Engineer position
and detailed k} Supply; and one Supply Firefighter will be transferred back to Operations to fill the vacancy
created by the deleted vacant Firefighter.
On September 18,2012, (Ordinance Number 2O411-O9-2O12\ the City Council adopted the Budget
ordinance which established the total number of authorized positions. Approval of the attached ordinance
would result in a new authorized staffing level as follows:
