AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE STORMWATER UTILITY FUND IN THE
AMOUNT OF $328,091.00, DECREASING THE UNASSIGNED FUND
BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF FUNDING
THE MOBILE LIDAR PROJECT; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-
2013 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Stormwater Utility Fund in the amount of $328,091.00, decreasing the
unassigned fund balance by the same amount, for the purpose of funding the Mobile LiDAR
Project.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances
and appropriations amending the same except in those instances where the provisions of this
ordinance are in direct conflict with such other ordinances and appropriations, in which instance
said conflicting provisions of said prior ordinances and appropriations are hereby expressly
repeated.
SECTION 4
This ordinance shall take effect upon adoption.

RECOMMENDATION:
|tiS recommended that the City Council:
1. Authorize transfer Vf funds from the Lake Worth Gas Lease Capital Improvements FundU3thm
Stormwater Utility Fund in the amount of $99,707.00;
2. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the
Stormwater Utility Fund in the amount of $99,707.00 from available funds;
3. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Stormwater
Utility Fund inthe amount of $328,091.00 decreasing the available cash balance by the same amount;
and
4. Authorize the execution of a professional services Agreement in the amount of $427,798.00 with
DISCUSSION: Michael Baker Jr., Inc., for the Mobile LiDAR Project.
The professional services Agreement recommended by this Mayor and Council Communication is for the
Mobile LiDAR (Light Debection and Ranging) project; 8 survey data collection and OOodp|oin mapping
project that will correct FEMA O0odpkaiD mapping ernonS, resulting in 8 direct economic benefit to
negatively affected property owners. The project VViU8\G0qU8Ddf»theDUn1he[aOdh/peSof dock and pier
structures in Lake Worth, enhance emergency response operations, and develop detailed topographic
information to assist in trail and park enhancements around Lake Worth.
On September 25, 2009, FEMA updated all of the floodplain maps for the City of Fort Worth. The City is
required to use these maps so that affordable flood insurance will continue to be available to our
residents, and the premiums will be reflective of the actual risk. Unfortunately, the 2009 floodplain maps
included many significant errors, incorrectly placing as many as 500 homes and businesses in the
floodplain. The City of Fort Worth is required by federal regulations adopted by our Floodplain Provisions

Ordinance torequest re-mapping of incorrect FEMA floodplain boundaries when the boundaries are
known to be inaccurate.
The average cost to a resident of Fort Worth for a flood insurance policy in a floodplain is approximately
$050.00 per year. Force-placed flood insurance policies through mortgage companies are frequently two-
three times more expensive. The errors in this particular situation COuk] impose as much as $1.4 million im
unwarranted flood insurance premiums on Fort Worth property owners.
Mobile LiDAR technology will be utilized to quickly and accurately survey each of the project are8sto
determine h> what extent the floodp|8in must be re-mapped. Contour data generated by the Mobile Li[)AR
survey will be used to determine accurate boundaries of the FEMA floodplain and finish floor elevations for
all insurable structures in the project @r88S to provide the required proof to FEMA and mortgage
companies. This project will greatly reduce the amount of staff time required toassist the property owners
in this area and establish UVodp|ain maps that are reflective of the actual risk offlooding.
Stormwater staff is also coordinating with Water Department to include a survey of dock and pier
structures in Lake Worth, as well as developing detailed topographic information for use in park and trail
planning. A normal pool elevation contour for Lake Worth will also be created, and emergency response
operations will benefit by identifying the most flood-prone areas. The technology will also be evaluated 8s
an alternate method of determining impervious cover for UU|itv rate billing. Fina||y, the high-resolution
elevation data will be used to model existing storm drain systems and feasible improvements in the Hulen
Bend project 8[e8.
The VV@ier Department is funding $99.707.00 for the Lake Worth shoreline survey. The Sun/8y of the lake
perimeter will include documenting boat dock locations and data to be used during the planning of the trail
system.
Michael Baker Jr. Inc., proposes 0O perform this project for a |urnp-sunl fee of $427,798.00. Staff
considers this fee to be fair and reasonable for the scope of work proposed, based on the size Of the study
areas and the deliverables.
M/VVBE - Michael Baker Jr. Inc., is in compliance with the City's M/VVBE Ordinance by C0nnrniUjng to 24
percent M/WBE participation. The City's goal on this project is 24 percent.

FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations
and adoption of the attached supplemental appropriation ordinances, funds will be available in the current
operating budget, as appropriated, 0fthe Stor0Ow8ter Utility Fund. Upon approval, the available cash
balance of the 8hornlvv8her Fund will be in compliance with the rnininlVrn reserve as outlined in the
Financial Management Policy Statements.
