HomeMy WebLinkAboutOrdinance 20545-12-2012Ordinance No. 20545-12-2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORMWATER UTILITY FUI'� D IN THE AMOUNT OF $99,707.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE MOBILE LIDAR PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012- 2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Stormwater Utility Fund in the amount of $99,707.00, from available funds, for the purpose of funding the Mobile LIDAR Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. On September 25, 2009, FEMA updated all of the floodplain maps for the City of Fort Worth. The City is required [o use these maps sothat affordable flood insurance will continue tobe available tnour residents, and the premiums will be reflective Vf the actual risk. Unfortunately, the 2OO9Uoodp|ainmaps included many significant errors, incorrectly placing as many as 500 homes and businesses in the floodp|@in. The City of Fort Worth is required by federal regulations adopted by our F|oodp|3in Provisions Lugn4me:20MOBlLEUDAR Pagelof3 Ordinance to request re-mapping of incorrect FEMA floodplain boundaries when the boundaries are known b}beinaccurate. The average cost to a resident of Fort Worth for a flood insurance policy in a floodplain is approximately $850.00 per year. Force-placed OOOd insurance policies through mortgage companies are frequently two- three Linle8 more expensive. The errors in this particular situation COU|d impose as D1UCh as $1.4 DOiUi0O in unwarranted flood insurance premiums On Fort Worth property owners. Mobile LiDAR technology will be utilized to quickly and accurately survey each of the project areas k} determine k] what extent the flOodp|ain must be re-mapped. Contour data generated by the Mobile LiDAR survey will be used to determine accurate boundaries Of the FEK4AUoodp|@in and finish floor elevations for all insurable StRJCtU[eg in the project areas to provide the required proof to FEK4A and mortgage companies, This project vvi||gne8UynBdVCe the amount nf staff time required tOassist the property owners in this area and establish floodplain maps that are reflective of the actual risk of flooding. 8k][mwat8r staff is also coordinating with Water Department tO include a survey Of dock and pier structures in Lake Worth, as well as developing detailed topographic information for use in park and trail planning. A normal pool elevation contour for Lake Worth will also be created, and emergency response operations will benefit by identifying the most flood-prone areas. The technology will also be evaluated as an alternate method of determining impervious cower for utility rate billing. Fina||y, the high-resolution elevation data will be used to model existing storm drain systems and feasible improvements in the Hulen Bend project area. The Water Department is funding $99,707.00 for the Lake Worth shoreline survey. The survey of the lake perimeter will include documenting boat dock locations and data to be used during the planning of the trail system.
