HomeMy WebLinkAboutOrdinance 16897-04-2006ORDINANCE NO. 1689'7-04-2006 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF AN ALLEY ADJACENT TO LOTS 3 AND 10, BLOCK 28 OF TUCKERS ADDITION, AN ADDITION TO THE CITY OF FORT WORTI-I, TAI2RANT COUNTY, TEXAS AS RECORDED IN VOLUME 63, PAGE 124 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS, BEING AN ALLEY 11 FEET WIDE, AND CONTAINING 1099 SQUARE FEET, OR 0.02 ACRES OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of an alley adjacent to Lots 3 and 10, Block 28 of the Tuckers Addition, an addition to the City of Fort Worth, Tarrant County, Texas as recorded in Volume 63, Page I24 of the Plat Records of Tarrant County, Texas and being an alley eleven (llj feet wide and containing 1099 square feet, or 0.02 acres of laxxd, a~ad as more specifically described in Exhibits "1", " 2", and " 3" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the laud in the above-described vacated alley is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. DISCUSSION: Brookes Baker Surveyors has requested the above referenced vacation, on behalf of Vandervoort's Dairy Food Company of Fort Worth, Texas, in order to replat it into the adjacent property. The Engineering Department, Real Property Services Division, states that the purchase fee of $1,896.12 has been received. Reviewing City departments and public utility companies have raised no objections to this request. The City Plan Commission recommended approval of this request at its meeting on March 22, 2006. The right-nf- way being vacated is being retained as an easement for existing utilities. A suitable re-plat (1=S-05-298) has been received. This vacation is located in COUNCIL DISTRICT 8.
