Authorize amendment to Mayor and Council Communication 21-0193, which called for the transfer back of $1,260,000.00 to the Crime Control and Prevention District Fund operating fund balance, so that the action takes effect in Fiscal Year 2021 instead of Fiscal Year 2020; and 2. Adopt the attached ordinance, repealing and replacing ordinance 24749-03-2021 so that appropriation is effected in Fiscal Year 2021. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to amend the fiscal year (FY) in which actions approved in M&C 21-0193 take place so that they occur in FY2021 instead of FY2020. M&C 21-0193 was approved on March 9, 2021, reducing appropriations in the Crime Control and Prevention District (CCPD) Capital Projects Fund by $1,260,000.00 and approving return of those funds back to the CCPD (Operating) Fund. This change reflected the impact of a spring 2020 decision to pay for FY2020 vehicle purchase out of tax note proceeds to preserve cash on hand in case it was needed due to impacts of the pandemic. Following the return of the money to the CCPD operating Fund, those dollars would be applied towards fund balance and be available for future appropriation and use. The reduction in the capital fund and transfer back to the operating fund were intended to occur in FY2020. Due to the timing of the M&C's adoption, the Financial Management Services Department had already completed the annual audit and finalized the FY2020 Annual Comprehensive Financial Report. This M&C requests City Council take action so that returning the transfer of $1,260,000.00 from capital to operating occur in FY2021. The FY2021 operating budget for the CCPD Fund will not be impacted by this action. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Vehicles -Police programmable project within the CCPD Capital Projects Fund and upon approval of the above recommendation, funds will be available in the Crime Control & Prev Distr Fund.
