Report of City Staff: David Creek; b. Citizen Presentations; c. Council Action: Close Public Hearing and Act on M&C) RECOMMENDATION: It is recommended that the City Council: 1. Conduct a public hearing under the guidelines set forth by the Texas Parks and Wildlife Code, Chapter 26, Protection of Public Parks and Recreational Lands; 2. Find that no feasible or prudent alternative exists for the use of Trinity Park for the installation of a 36-inch sanitary sewer force main; 3. Find that the proposed 36-inch sanitary sewer force main with maintenance area includes all reasonable planning to minimize harm to the parkland, including that all infrastructure and equipment will be constructed in Trinity Park as specified on the attached exhibits and as noted in the discussion below; and 4. Close the public hearing and authorize the use of approximately 1.22 acres of dedicated parkland at Trinity Park for the proposed 36-inch sanitary sewer force main maintenance area and approximately 1.8 acres of temporary construction access and workspace. DISCUSSION: The Park & Recreation Department (PARD) has been approached by the City of Fort Worth Water Department (Water Department) requesting a conversion of approximately 1.22 acres of parkland within Trinity Park for the installation of a 36-inch sanitary sewer force main. The proposed project is included in the 5-year Capital Improvement Program (CIP) and sanitary sewer corrective action plan with the Texas Commission on Environmental Quality (TCEQ). The existing sanitary sewer line located south of Trinity Park lacks capacity to meet current and future demands. Therefore, a 36-inch force main is proposed to bypass areas of the system that have insufficient capacity. This force main bypass line has been identified as high priority in the CIP, and is critical to meeting the City's current and future wastewater flow demands and will provide mitigation efforts to problematic sanitary sewer overflow events currently experienced in the general area. The proposed force main will enter the south end of Trinity Park (Park) near the intersection of University Drive and the West Freeway/1-30W and continue northeast through the Park and exit the Park beneath the Clear Fork of the Trinity River. The proposed 36-inch force main is approximately 4,000 feet long and will be installed at a depth of 10-15 feet within the park. A maintenance area, 20-feet wide, will be centered on the pipe location with total area of approximately 5,882 square feet or 1.22 acres. The proposed temporary construction access and workspace equates to approximately 78,408 square feet or 1.8 acres. Construction will be completed in two phases with small areas of the park to be closed during each phase. The temporary construction access and workspace in the park will be restored to previous condition or better upon completion. No construction activity or park closures will take place from early January through mid -May. The City Forester has reviewed the plans for the removal of eight trees. Based on the health and condition of the trees, the City Forester has assessed a fee $12,900.00 for the removal of four trees including 2" caliper Bur Oak, 23.5" caliper Cedar Elm, 17.5" Gum Bumelia, and 21.5" Osage Orange. Water Department will work with the Contractor to reduce the number of trees to be removed, if possible, based on site conditions. If trees are not removed, the City Forester will reassess fees based on actual tree removals once construction is complete. The existing trees in proximity to the proposed construction will be protected with fencing. In addition, the Water Department, in coordination with the PARD, has developed a trail detour route during construction. The Water Department will ensure that public communications will be conducted to adequately inform the general public and park users throughout the project. The Contractor and Water Department will coordinate with the PARD on park access, special events, and other issues impacting the park and park users. On May 26, 2021, the Park & Recreation Advisory Board endorsed Staffs recommendation to the City Council to authorize the use of Trinity Park for the installation of a sanitary sewer service with maintenance area. In accordance with State law, public notice of the hearing was advertised in the Fort Worth Star -Telegram on July 20, 2021, July 27, 2021, and August 3, 2021. An exhibit map was available for public review on the Park & Recreation Department website. Signage was posted at the site noting the proposed use and providing instructions for directing comments to the Park & Recreation Department. Announcement was posted on the City Web page beginning July 10, 2021. An email announcing the proposed conversion was sent to the presidents of Colonial Hills NA, Cultural District Alliance, FW Downtown Neighborhood Alliance, Linwood NA, Mistletoe Heights NA, Montgomery Plaza Residential Condominium Association, SO7 Townhome Association, Sunset Terrace NA, West 7th Neighborhood Alliance, and Westside Alliance on July 2, 2021. Staff will note any public comment received during the public hearing Report of City Staff. Trinity Park is located in COUNCIL DISTRICT 9. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the current capital budget, as appropriated, in the W&S Capital Proj 2018 Fund for the Clear Fork LS and FM project to support the approval of the above recommendations, funds will be deposited into the Tree Mitigation Fund for the removal of the trees. The Park & Recreation Department (and Financial Management Services) is responsible for the collection and deposit of funds transferred from the Water Department.
