BRADSIIAW, ANN Y, COLLINS, FAME R. HARDEN, NELDA F.
HARRIS, CARLA G. KELIVIAN, NANCY A. MAGEE, NEMUEL E.
PETTIE, NANCY E. STRICKLAND, PATRICIA I.. SUMMERS, AND
EDWARD B. VALVERDE AS SUBSTITUTE MUNICIPAL JUDGES FOR
A ONE YEAR TERM COMMENCING APRIL 1, 2Q06 ANID ENDING
MARCH 3I, 20U'1 OR UNTIL A SUCCESSOR IS QUALIFIEIB AND
APPOINTED IN ACCORDANCE WITH STATE LAW; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

TEXAS:
SECTION ~ .
That Charles F. Berger, Andrew Bradshaw, Ann Y. Collins, Faye R. Harden, Nelda F.
Harris, Carla G. Kelan, Nancy Magee, Nemuel E. Pettie, Nancy E. Strickland, Patricia L.
Summers, and Edward B. Valverde be reappointed as substitute Municipal Judges for a one year
term commencing April 1, 2006 and ending March 31, 2007, or until a successor is qualified and
appointed in accordance with state law.
SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances and of the Cade of the
City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are
in direct conflict with the provisions of such ordinances and Gode, in which event such
conflicting provisions of such ordinances and Cade are hereby repealed.
SECTI®N 3.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared void, ineffective or
unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such
ineffectiveness ar unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this ordinance, since the same would have been enacted by
the City Council without the incorporation herein of any such void, ineffective or
unconstitutional phrase, clause, sentence, paragraph ar section.
SECTIOIi~ 4.
This ordinance shall take effect upon adoption.

RECOMIIdIENDATION:
It is recommended that the City Council adopt the attached ordinance reappointing Charles 1=. Berger,
Andrew Bradshaw, Ann Y. Collins, Faye R. Harden, Nelda F. Harris, Carla G. Kelman, Nancy A. Magee,
Nemuel E. Pettie, Nancy E. Strickland, Patricia 1_. Summers, and Edward B. Valverde for a one year term
commencing April 1, 2006 and ending March 31, 2007, ar until a successor is qualified and appointed in
accordance with State law.
DISCUSSION:
Chapter 30 Section 30.001}D8 of the Government Cnde states that the governing body of the municipality
may appoint one or more qualified persons to be available to serve for a Municipal Judge who is temporarily
absent due to illness, family death, continuing legal or judicial education programs, ar any other reason. The
presiding judge shall select one of the qualified persons appointed by the governing body to serve during
the absence of a Municipal Judge. The substitute judge, while serving as a Municipal Judge, has al! the
powers, and shall discharge all the dufiies of a Municipal Judge.
Al! of the named persons cited above meet the qualifications prescribed for the Municipal Judge.
On April 12, 2006, the Ad Hoc Municipal Court Advisory Committee voted to recommend to the City Council
the above listed persons for reappaintmenfi as substitute Municipal Judges.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that this action will have no material effect on City funds.
