FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER MAIN REPLACEMENT ON COCKRELL AVENUE FROM SOUTHWEST LOOP 820 TO RUTLAND, ODESSA AVENUE 1=ROM SOUTHWEST LOOP 820 TO WOSELY, WEDGEMONT CIRCLE NORTH FROM WILKIE WAY TO WHITMAN AND WESSEX AVENUE FROM WELCH TO WEDGEMONT CIRCLE NORTH (2004 CIP PROJECT NO. 00023); MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVibING AN EFFECTIVE BATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2005 in the Budget of the City Manager, there shah also be increased estimated receipts and appropriations in fibs Water Capital Project Fund in the amount of $615,937 and the Sewer Capital Project Fund in the amount of $953,188 Pram available funds far the purpose of funding a contract with McClendon Construction Co., Inc. for Pavement Reconstruction and Water and Sani#ary Sewer Main Replacement on Cockrell Avenue from Southwest Loop 820 to Rutland, Odessa Avenue from Southwest Loop 820 to Wosely, Wedgemant Circle North from Wilkie Way to Whitman and Wessex Avenue from Welch to Wedgemont Circle North (2004 CIP Project Na. 00023}. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. It is recommended that the City Council: 1. Authorize the transfer of $1,570,126.00 firom the Water and Sewer Operating Fund to the Water Capital Projects Fund- in the amount of $016,937.00 and Sewer Capital Projects Fund in the amount of $953,189A0; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $016,937.00 and the Sewer Capitai Projects Fund in the amount of $953,189.00, from available funds; and 3. Authorize the City Manager to execute a contract with McClendon Construction Co., Inc., in the amount of $2,009,045.00 for pavement reconstruction and water and sanitary sewer main replacement on Cockrell Avenue (Southwest Loop 820 to Rutland Avenue), Odessa Avenue (Southwest Loop 820 to Worley Drive}, Wedgmont Circle North (Wilkie Way to Whitman Avenue) and Wessex Avenue (Welch Avenue to Wedgmont Gircle North) (Project No. 00023}. DISCUSStOIV: On September 14, 2004, (M&C C-20270) the City Council authorized the City Manager to execute an engineering agreement with Dannenbaum Engineering Corporation for pavement reconstruction and water and sanitary sewer main replacement on Cockrell Avenue (Southwest Lanp 820 to Rutland Avenue), Odessa Avenue {Southwest Loop 820 to Worley Drive), Wedgmont Circle North (Wilkie Way to Whitman Avenue) and Wessex Avenue {Welch Avenue to Wedgmont Circie North) (Project No. 00023). The 2004 Capital Improvement Program {CIP} includes funds for pavement reconstruction and the Water and Sewer Operating Fund includes funds for water and sanitary sewer replacements on all streets mentioned above. S#reet improvements include pavement reconstruction, construction of standard concrete curb and gutter and driveway approaches as indicated on the plans. A meeting with the citizens was held before this project was advertised for bid and the citizens unanimously voted not to construct sidewalks in these streets. There are also na public facilities (school, hospitals, etc.) in the nearby areas. The Water Department has determined that severely deteriorated water and sanitary sewer Lines should be Lagname: 30000;Kk.ELL00023 Page 1 of 3 replaced prior to street reconstruction. The project was advertised on November 3, 2005 and November 10, 2005. No Bid $3,203,455.(30 Time of Completion: 200 Working Days Bids were received on two alternates: . Alternate "A" consists of a 6anch hat mix asphalt concrete (HMAC} aver 8-inch lime stabilized subgrade with 7-inch concrete curb and 18-inch gutter. ~ Alternate "B" consists of a 6-inch concrete over B-inch lime stabilized subgrade with 7-inch concrete curb. After reviewing all bid proposals, staff recommends Alternate "B" (concrete) for construction since the use of cnncrete will result in less maintenance cost over the street's useful life and the cost difference between the asphalt and concrete pavement is less than 2%. Funding in the amount of $79,173.00 is included for associated water and sewer construction survey, project management, pre~constructian, material testing, inspection and project afore out (water $41,400.00 and sewer $37,773.00}. The contingency funds to cover change orders total $70,998.00 (water $27,4D7.D0 and sewer $43,591.OD). Funding in the amount of $111,256.00 is required for associated paving and drainage construction survey, project management, pre-construction, materia! testing, inspection and project close out. The contingency fund for possible change orders for paving and drainage improvements is $35,691.D0. M/WBE -McClendon Construction Co., Inc., is in compliance with the City's MIWBE Ordinance by committing to 20% M/VIIBE participation and documenting good faith effort. McClendon Construction Ca., Inc., identified several subcontracting and supplier opportunities. However, the MNVBE contacted in the areas identified did not submit the lowest bids. The City's goal on this project is 27%. This project is located in COUNCIL DISTRICT 6, Mapsco 89U,X and 90N..
