Ordinance No. 9 69 9 404-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS iN THE SPECIALLY FUNDED CAPITAL PROJECTS FUND IN THE AMOUNT OF $2,395,659 FROM AN AMENDED LOAN AGREEMENT WITH THE STATE ENERGY CONSERVATION OFFICE, FOR THE PURPOSE OF FUNDING PHASE II OF THE ENERGY SAVINGS PERFORMANCE CONTRACT WITH JOHNSON CONTROLS, INC.; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIb[NG AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 9 That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of $2,395,659 from an amended loan agreement with the State Energy Conservation Office, for the purpose funding Phase II of the Energy Savings Performance Contract with Johnson Controls Inc.. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any ~'easan by a court of competent jurisdiction, such decision, opinion or judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 98582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. RECOMMENDATION: It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of $2,395,659 from the amended loan agreement with the State Energy Conservation Office (SEGO). DISCUSSION: On February 7, 2006, (M&C C-21289} City Council authorized staff to execute an amendment in the amount of $2,395,659 to an existing loan agreement with SEGO and to finance implementation of Phase II of the City's Energy Savings Performance Contract with JCI. On July 29, 2©03, (M&C C-19687 } City Council authorized the original Iran agreement with SEGO in the amount of $2,596,470. The appropriation ordinance recommended by this M&C is necessary sn that funds will be available to make mnnfihly progress payments to JGI as the project work progresses. During construction, city approved JCI requests for payment will be forwarded to the State for reimbursement. The Fund/AccountlCenters listed below will be used to both receive these reimbursements from the State and to make the associated construction progress payments to JCI. FISCAL INFORMATIONICERTIFICATION: The Finance Director certifies that upon adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Specially Funded Capital Projects Fund.
