CITYSECREFARY PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF FORT
WORTH AND RAR FARMER FOR FWPA MURAL ARTIST-IN-RESIDENCE WITH
GAP PUBLIC ART PROJECT
This First Amendment of City Secretary Contract No. 55672 ("Agreement") is by and between the
City of Fort Worth ("City"), a home-rule municipal corporation of the State of Texas, acting by
and through its duly authorized Assistant City Manager and Rar Farmer, an individual
("Consultant"). The City has designated the Arts Council of Fort Worth & Tarrant County, Inc.
("Contract Manager") to manage this Agreement on its behalf.
WHEREAS, on May 4, 2021,the City and Consultant entered into a professional services
agreement(City Secretary Contract No. 55672)to work with the Park&Recreation Department's
Graffiti Abatement Program(GAP) staff to assess the program, identify successes and challenges,
and develop a strategic plan to support successful outcomes and long-term program goals as
recommended by the Fort Worth Art Commission and detailed in the Agreement;
WHEREAS, the Term of the Agreement was set to begin at the effective date and extend
until final payment or six months from the Effective Date, whichever comes sooner;
WHEREAS, due to personal circumstances related to COVID-19,the Consultant requires
additional time to complete the scope of work and deliverables;
WHEREAS, Consultant has provided satisfactory preliminary services and it is the
collective desire of both City and Consultant to amend the Agreement to provide Consultant with
additional time to complete services under the Agreement;
WHEREAS, the Term of the Agreement and Compensation Schedule will need to be
amended in order to provide Consultant with such opportunity.
NOW THEREFORE, in consideration of the mutual covenants herein expressed, the
Parties agree to amend the Agreement as follows:
I.
AMENDMENTS
Article 3.2 "Payment Schedule" is hereby amended and replaced in its entirety with
the following:
3.2. Payment Schedule.
City agrees to pay Consultant in the following installments set forth below, each installment to
represent full and final, non-refundable payment for all services and materials provided prior to the due
date thereof: -

a. ONE THOUSAND DOLLARS AND NO CENTS($1,000.001 upon execution of this
Agreement.
b. TWO THOUSAND DOLLARS AND NO CENTS ($2,000.00) within thirty (30) days
after the Consultant meets with GAP staff as required in Section 2.l.b of this Agreement
and other collected data.
C. TWO THOUSAND DOLLARS AND NO CENTS ($2,000.00) within thirty (30) days
after the Consultant submits preliminary results of research as required in Section 2.Lc and
d. of this Agreement.
d. TWO THOUSAND DOLLARS AND NO CENTS ($2,000.00) within thirty (30) days
after the Consultant submits preliminary results of exploratory Workshop or forum and as
required in Section 2.Le of this Agreement and other collected data.
e. TWO THOUSAND DOLLARS AND NO CENTS($2,000.00) within(30)day after the
Consultant submits a DRAFT GAP Program Plan for review by Contract Manager and
PARD staff as required in Section 2.1.g of this Agreement.
f. SIX THOUSAND DOLLARS AND NO CENTS ($6,000) within thirty (30) days after
the Consultant makes a presentation to the Fort Worth Art Commission and has received
the City's approval of the GAP Program Plan.
Article 4.1 "Term" is hereby amended and replaced in its entirety with the following:
4.1 Term.
"This Agreement begins on the date signed by the Assistant City Manager ("Effective
Date") and expires on March 30, 2022 ("Expiration Date"), unless terminated earlier in
accordance with this Agreement.
II.
ALL OTHER TERMS SHALL REMAIN THE SAME
All other terms, provisions, conditions, covenants and recitals of said Agreement not
expressly amended herein shall remain in full force and effect.
III.
ELECTRONIC SIGNATURE
This Amendment may be executed in multiple counterparts, each of which shall be an
original and all of which shall constitute one and the same instrument. A facsimile copy or
computer image, such as a PDF or tiff image, or a signature, shall be treated as and shall have the
same effect as an original.
