HomeMy WebLinkAboutOrdinance 20560-01-2013Ordinance No. 20560-01-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE LAKE WORTH GAS LEASE CAPITAL IMPROVEMENT FUND IN THE AMOUNT OF $293,665.00, FROM GAS WELL REVENUES, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE GENERAL FUND TO CONDUCT A GREENPRINTING STUDY OF THE LAKE WORTH WATERSHED; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Lake Worth Gas Lease Capital Improvement Fund in the amount of $293,665.00, from Gas Well Revenues, for the purpose of transferring said funds to the General Fund to conduct a Greenprinting Study of the Lake Worth watershed. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the City Manager to execute an Interlocal Agreement with the North Central Texas Council of Governments to prepare a Natural Resource Assessment also known as a Greenprinting Study of the Lake Worth Watershed in the amount of $268,665.00, plus a contingency of $25,000.00; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Lake Worth Gas Lease Capital Improvement Fund in the amount of $293,665.00 from Gas Well Revenues; 3. Authorize a transfer in the amount of $293,665.00 from the Lake Worth Gas Lease Capital Improvement Fund to the General Fund; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the General Fund in the amount of $293,665.00. DISCUSSION: In 2011, (Resolution No. 3985 -05 -2011) the City Council adopted the Lake Worth Vision Plan and incorporated it by reference into the Comprehensive Plan. The Lake Worth Vision Plan seeks to accommodate future growth within the Lake Worth watershed while protecting water quality and providing for future recreational opportunities within the watershed. A principal recommendation of the Lake Worth Vision Plan was to conduct a science -based assessment of the Lake Worth watershed. The North Central Texas Council of Governments (NCTCOG) recently contracted with the Trust for Public Land to conduct assessments of Lake Lewisville West and Lake Arlington watersheds. These watershed assessments employ a technique developed by the Trust for Public Land called Greenprinting, which uses a systematic, science -based approach to identify the specific target areas within a watershed that offer the greatest potential benefit for water quality protection, recreation, and wildlife habitat protection. An Interlocal Agreement has been created to authorize NCTCOG to expand its existing contractual relationship with the Trust for Public Land to perform a Greenprinting study of the Lake Worth Watershed Logname: 06LAKE WORTH GREENPRINTING STUDY ILA Pagel of 3 on behalf of the City of Fort Worth. The Greenprinting study will identify specific, targeted conservation opportunities in the watershed that yield the greatest water quality benefits to protect the City's drinking water supply, while ensuring that appropriate future recreational opportunities are identified and preserved for Fort Worth citizens. The Trust for Public Land will review existing plans and develop a GIS -based model of the Lake Worth watershed to determine where conservation measures for water quality provide the most return on investment, while informing an evaluation of the relative importance for water quality protection of the land the City currently owns in the watershed. The scope of work includes significant community engagement elements to keep landowners and neighborhoods informed and to involve them in the watershed assessment process. Additionally, the Trust for Public Land will provide research on successful local government tools and public - private approaches that can help to manage growth and development in the watershed to protect water quality. The Lake Worth Regional Coordination Committee will serve as the steering committee for this study. The cost of the Greenprinting study is $268,665.00. Administrative authorization to spend an additional $25,000.00 is requested to cover possible amendments to the contract and not to require specific City Council approval as long as sufficient funds have been appropriated. Gas well revenues from Lake Worth will cover the cost of the study, along with $48,000.00 of remaining City funds held by NCTCOG from a previous watershed management project. In 2008, the City Council authorized revenues from gas well bonuses and royalties to be allocated for the funding of the Lake Worth Capital Improvements Implementation Plan (LWCIIP). This plan contains an allocation of $9,550,000.00 for a Maintenance Fund to maintain improvements that are part of the LWCIIP. The Greenprinting study will provide the data necessary to identify areas in the Lake Worth watershed that have value in mitigating future sediment and nutrient loading to the lake, thereby, helping to extend the life and beneficial effects of the currently funded dredging project at Lake Worth. In 2008, the City Council authorized revenues from gas well bonuses and royalties to be allocated for the funding of the Lake Worth Capital Improvements Implementation Plan (LWCIIP). This plan contains an allocation of $9,550,000.00 for a Maintenance Fund to maintain improvements that are part of the LWCIIP.
