AN ORDINANCE VACATING AND EXTINGUISHING A TWENTY
FOOT ALLEY RIGHT -OF -WAX LOCATED BLOCK 6, OF EDWARDS
HEIRS ADDITION, AN ADDITION TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, AS FILED IN VOLUME 63, PAGE 2 OF
THE PLAT RECORDS OF TARRANT COUNTY, TEXAS; CONTAINING
APPROXIMATELY 0.092 ACRE OF LAND; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF
EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a twenty (20) foot wide alley right -of -way, situated in and being a portion of Block
6, of Edwards Heirs Addition, an addition to the City of Fort Worth, Tarrant County, Texas as
recorded in Volume 63, Page 2 of the Plat Records of Tarrant County, Texas; containing
approximately or 0.092 acres of land more or less, and as more specifically described in Exhibits
"A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 2.
That the fee to the lands in the above - described vacated alleys and easements are hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in the easements are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a tract of land situated in G. Sheilds Survey, Abstract No. 1402, City of Fort Worth, Tarrant County,
Texas, same being a 20 foot alley located in Block 6, of Edwards Heirs Addition, an addition to the City of
Fort Worth, Tarrant County, Texas as recorded in Volume 63, Page 2, Plat Records, Tarrant County, Texas
and being more particularly described by metes and bounds as follows (bearings referenced to the north
line of Lot 1, Block 6, said Edwards Heirs Addition):
COMMENCING at a found 1/2 inch iron rod for the northeast corner of said Lot 1, same point being in the
southwest intersection of West Cannon Street (a 50 foot Right-of-Way) and 9m Avenue (a 50 foot Right-of-
Way);
THENCE WEST with the common line of said West Cannon Street and the north line of said Lot 1, a
distance 140.00 feet to a set 5/8 inch capped iron rod marked "BHB INC" for the POINT OF BEGINNING
from which a found 1/2 inch iron rod bears North 28 °44' West, a distance of 2.2 feet;
THENCE SOUTH departing the said common line and with the east line of the aforesaid 20 foot alley, a
distance of 200.00 feet to a found 1/2 inch capped iron rod marked "RPLS 1966" for the southwest corner
of Lot 2, Block 6, aforementioned Edwards Heirs Addition, same point being in the north right-of-way line of
Cooper Street (a 60 foot Right-of-Way);
THENCE WEST with the north line of said Cooper Street, a distance of 20.00 feet to a found 3/8 inch iron
rod for the southeast corner of Lot 3, Block 6 said Edwards Heirs Addition;
THENCE NORTH departing the north line of said Cooper Street and with the common line between said
Lots 3 and 4 of the said Edwards Heirs Addition and the west line of said 20 foot alley, a distance of 200.00
feet to a found 1/2 inch iron rod in the south right-of-way line of the aforementioned West Cannon Street,
same point being the northeast corner of Lot 4, Block 6, said Edwards Heirs Addition;
THENCE EAST with the south line of said West Cannon Street, a distance of 20.00 feet to the POINT OF
BEGINNING and containing 0.092 acres of land more or less;

Adopt Ordinance Vacating an Alley Between Cooper Street and Cannon Street to Adjacent Property Owner
(COUNCIL DISTRICT 9)
It is recommended that the City Council:
1. Adopt the attached ordinance vacating an alley between Cooper Street and Cannon Street hmadjacent
property owner; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (K8&C(]-
Baird, Hampton and Brown, Inc., on behalf of Walter Owen, has requested the vacation of this alley to
rep|cddwith the adjoining property for additional parking. The City Plan Commission recommended
approval mf this request at its meeting un July 25.2012. An acceptable rep|ai(FS-012-U95) has been
The City mf Fort Worth (Cdv) originally obtained the above mentioned hg through the platting
process. The City does not own land under or adjacent to the above referenced alley. Since no City funds
have been expended to purchase property or easement rights, collection of the fair market value or any
portion thereof is recommended by Staff tobewaived.
This project /s located in COUNCIL DISTRICT 9.
