Ordinance No. 16917-05-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATT=R AND SEWER OPERATING 1=UND IN THE AMOUNT OF $990,000 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A TRANSFER TO THE SEWER CAPITAL PROJECTS FUND FOR A CONTRACT WITH WILLIAM J. SCHULTZ, lNC. DBA C1RCI_E "C" CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF THE LAKE WORTH SOUTH SHORE GRINb1=R PUMP INSTALLATION; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TI XAS: SECTION 1. That in addition to those amounts allocated to tine various City departments for Fiscal Year 2005- 2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water and Sewer Operating Fund in the amount of $990,000 from available funds for the purpose of funding a transfer tq the Sewer Capital Projects Fund for a contract with William J. Schultz, Inc. dlaa Circle "C" Construction Company far the construction of the Lake Worth South Shore Grinder Pump Installation. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said romaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize fihe transfer of $990,000.00 from the Lake Worth Infrastructure Escrow Account fio the Water and Sewer Operating Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water & Sewer Operating Fund ih the amount of $990,000.00; 3. Authorize the transfer of $990,000.00 from the Water 8~ Sewer Operating Fund to the Sewer Capital Projects Fund; 4. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capita[ Projects Fund in the amounfi of $990,000.00; and 5. Authorize the City Manager fio execute a confracfi with William J. Schultz, Inc. dlbla Circle "C" Construction Company for fihe construction of the Lake Worth South Shore Grinder Pump Installation in an amount not fio exceed $988.830.00. DISCUSSION. The contract provides for the installation of individual grinder pumps at each of 100 lots in four service areas along the south shore of Lake Worth. The four areas include 8816 Heron Drive to 8120 Heron Drive, 8200 Shoreview fio 1349 Somber Road, 9604 Heron Drive to 9840 Goodnight Circle and 2416 to 2472 Indian Cove Circle. The grinder pumps will discharge into slow-pressure sewer system, which is currently under construction. The project was advertised for bid on December 1 and December 8, 2005. On January 19, 2006 the following bids were received: .B_ IpD~RS. Circle "C" Construction Company is in compliance with the City's MIWBE Ordinance lay committing to 19% MNVBE participation. The City's goal on this project is 18%.
