A RESOLUTION AUTHORIZING THE SALE OF CERTAIN REAL PROPERTY
WHEREAS, pursuant to (i) a judgment in a tax foreclosure lawsuit styled Cause
No. B27952 -92, City of Fort Worth and State of Texas, County of Tarrant, et. al. v. Tex
Star Realty, Inc, and (ii) a subsequent Constable's Deed, the Fort Worth Independent
School District, for itself and the use and benefit of Tarrant County and the City of Fort
Worth, acquired title to the Property (as defined below); and
WHEREAS, Section 34.05(a), Texas Property Tax Code, authorizes the Fort
Worth Independent School District to resell the Property with the consent of the taxing
entities who were party to the suit, and the City of Fort Worth was a party to the suit;
WHEREAS, it is in the best interest of the City of Fort Worth and its taxpayers to
return this Property to a productive use; and
WHEREAS, an offer has been made by Efrain D. Negrete to purchase the Property
for the sum of Three Thousand Seven Hundred Seventy -Seven and 051100 Dollars
($3,777.05).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
1. The City of Fort Worth hereby consents to the sale of the Property, which is
defined as the following:
West 35 Feet of Lot 9, East 15 Feet of Lot 10, Block 60, Highland to
Glenwood Addition, an Addition to the City of Fort Worth, Tarrant
County, Texas and located within the Fort Worth Independent School
District; Account Number 01226363, also known as 1919 Avenue D,
Fort Worth, Texas.
2. The Fort Worth Independent School District is authorized to sell, convey and
transfer the Property for the sum of $3,777.05, as authorized by Section 34.05,
Texas Property Tax Code to Efrain D. Negrete. The liens foreclosed by the

judgment and the post-judgment tax liens are extinguished by virtue of the
conveyance.
3. The City Manager or his designee is authorized to execute or record the
appropriate instruments to effect the conveyance of the Property as set forth
above.

WHEREAS, the City of Fort Worth, for itself and the use and benefit of Tarrant
County and the Fort Worth fridependent School District has acquired title to a certain
tract of real estate in Cause No. B27952.92, City of Fort Worth and State of Texas,
County of Tarrant, Et Al Vs Tex Star Realty Inc.; and
WHEREAS, Section 34.05(a), Texas Property 'Tax Code, authorizes the City of
Fort Worth, by and through its governing body, to resale the property; and
WHEREAS, it is in the best interest of the City of Fort Worth and its taxpayers to
return this property to a productive use; and
WHEREAS, an offer has been made by Efrain D. Negrete -chase the property

D. Negrete in the Amount of $3,777.05, in Accordance with Section 34.05 of the Texas Property Tax Code
(COUNCIL DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached Resolution consenting to the sale of a tax-foreclosed property located at 1919
Avenue D, Fort Worth, Texas, to Efrain D. Negrete in the amount of $3,777.05, in accordance with Section
34.05 of the Texas Property Tax Code; and
2. Authorize the execution and recording of the appropriate instruments conveying the property to
complete the sale.
DISCUSSION:
The Fort Worth Independent School District (FWISD) received the property located at 1919 Avenue D
after a tax foreclosure lawsuit in 1995. FWISD has received an offer to purchase the property from Efrain
D. Negrete for the amount of $3,777.05. Mr. Negrete owns the adjacent property and he would like to
incorporate the lot into his property.
In accordance with section 34.05 of the Texas Property Tax Code, the FWISD is able to sell the property
to Mr. Negrete with the consent of the taxing entities who were a party to the lawsuit. The liens foreclosed
by the judgment and the post-judgment tax liens will be extinguished at conveyance.
Upon the sale of the property, the FWISD will submit the sales proceeds to Tarrant County to distribute to
all parties to the judgment according to their interest.
Staff recommends the sale of 1919 Avenue D to Mr. Negrete.
The property is located in COUNCIL DISTRICT 8.

funds.
