'[69'[8-05-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $990,000 FROM AVAILABLE FUND5 FOR THE PURPOSE OF FUNDING A CONTRACT WITH WILLIAM J. SCHULTZ, INC. DBA CIRCLE "C" CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF THE LAKE WORTH SOUTH SHORE GRINDER PUMP INSTALLATION; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING TH15 ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: 5ECTlON 1. That in addition to thane amounts allocated to the various City departments for Fiscal Year 2005- 2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $990,000 from available funds far the purpose of funding a contract with William J. Schultz, Inc. dba Circle "C" Construction Company for the construction of the Lake Worth South Shore Grinder Pump Installation. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, ar parts of Sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. '!6582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are fiereby expressly repealed. SECTION ~. This ordinance shall take effect upon adoption. Schultz, Inc. d/b/a Circle "C" Construction Company for the Construction of the Lake Worth South Shore Grinder Pump Installation Project RECOMMENDATION; It is recommended that the City Council: 1. Authorize the transfer of $990,000AO from the Lake Worth Infrastructure Escrow Account to the Water and Sewer Operating Fund; 2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water & Sewer Operating Fund in the amount of $990,000.00; 3. Authorize the transfer of $99D,DDD.DD from the Water & Sewer Operating Fund to the Sewer Capital Projects Fund; 4. Adopt the attached appropriation nrdinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $990,OD0.00; and 5. Authorize the City Manager to execute a contract with William J. Schultz, Inc. d/b/a Circle "C" Construction Company for the construction of the Lake Worth South Shore Grinder Pump Installation in an amount not to exceed $968.630.00. DISCUSSION: The contract provides for the installation of individual grinder pumps at each of 100 lots in four service areas along the south shore of Lake Worth. The four areas include 8616 Heron Drive to 8120 Heron Drive, 8200 Shoreview to 9349 Bomber Road, 9604 Heron Drive to 9840 Goodnight Circle and 2416 to 2472 [radian Cove Circle. The grinder pumps will discharge into aloes-pressure sewer system, which is currently under construction. The project was advertised far bid an December 1 and December 8, 2005. Circle "C" Construction Company is in compliance with the City's MIINBE Ordinance by comnnitting to 19% M/WBE participation. The City's goal on this project is 18%. FISCAL INFORMATIQNICERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current capital budget, as appropriated, of the Sewer Capital Projects Fund.
