Constitutional Carry
• Effective 9/1/2021
• A person who is 21 years of age or older and has not been
convicted of specific offenses within the last 5 years, and is
not prohibited by state or federal law, may carry a handgun
(concealed or openly in a holster) in a public place except
in places where prohibited by law.
0 No License or background check required to carry
Licensed Carry (Open & Concealed)
Licensed Carry remains in effect
Reasons to retain licensed carry:
o May be required to carry in other states
o Eliminates the requirement for a background check to
purchase a firearm
Holster Requirements
• Allows other types of holsters (ankle, pocket, thigh, etc.)
• Prior law only allowed belt or shoulder holsters

Handguns in Plain View
• A person commits an offense
and intentionally displays the
person in a public place.

handgun was partially or wholly visible but was carried in a

Places Where Handguns Are Prohibited
• Open Meeting of Governmental Body (in compliance with Open Meetings

• Location where alcohol sales are 51% or more**
• Premises of Court or Court Office
• Penal Institution/Jail

Disarming a Person
• A peace officer acting in the lawful discharge of the officer's
official duties may disarm a person at any time the officer
reasonably believes it is necessary for the protection of the
person, officer, or another individual.
• The peace officer shall return the handgun to the person before
discharging the person from the scene if the officer determines
the person is not a threat to the officer, person, or another
individual and if the person has not committed a violation that
results in the arrest of the person.
Disarming a Person - Law Enforcement Facility
• A peace officer acting in the lawful discharge of the officer's
official duties may temporarily disarm a person when the person
enters a nonpublic, secure portion of a law enforcement facility,
if the law enforcement agency provides a gun locker or other
secure area where the peace officer can secure the person's
handgun.
• The peace officer shall secure the handgun in the locker or
other secure area and shall return the handgun to the person
immediately after the person leaves the nonpublic, secure
portion of the law enforcement facility.
Weapons Lockers
A political subdivision may provide temporary secure weapon
storage for a building or portion of a building for persons who
enter with a weapon prohibited in that building or portion of the
building.
• The temporary secure weapon storage may be provided by self-
service weapon lockers or other temporary secure weapon
storage operated at all times by a designated employee of the
political subdivision.
